As to the jailing issue, is the mandate not a tax? What happens when you do not pay your taxes? Pay Howard Schiff a weekend visit and find out. Actually I had never heard of the judge, and I find him quite correct. I am not an American, but what was said by the judge is correct. Governments gradually take back powers, look at the mess we have put ourselves in at all the airports. Health Care is certainly unconstitutional in America, though in Socialist constitutions like India, China it would not be unconstitutional, but nevertheless bad for the economy, and the poor people in particular.

First, pro-lifers are not against "control of your own body", they are for the right to life, liberty, and the pursuit of happiness. Second, the mandate is done through the IRS, so it counts as part of your taxes. Generally, when you dont pay your taxes, you go to jail. Lastly, the healthcare law is unconstitutional under the 9th and 10th amendments (powers not granted to the government in article 1 section 8 belong to the states and to the people). I listened to Napolitano's monologue with a skeptics ear, and I did not find any bit of it to be unfactual. Some of it was embellished with inflamatory filler, but nothing that was contrary to fact.
The TYT host's insinuation that because "almost all" Republicans voted for STUPAC and this was contradictory to Napolitano's position on the PPACA (aka "Obamacare") is pure logical fallacy.
Napolitano wasn't one of those Republicans. He hates STUPAC too.

Why is it against the Constitution? Have you read the Constitution? Section eight of Article I of the Constitution enumerates the nineteen powers granted to Congress. No where in those enumerated powers will you find authority to force citizens to engage in any type of commerce.
You find it laughable that the government would place citizens in jail for failure to comply with the mandate. The government has two primary methods of coercion: seizing your property and depriving you of your liberty.

Actually I had never heard of the judge, and I find him quite correct. I am not an American, but what was said by the judge is correct. Governments gradually take back powers, look at the mess we have put ourselves in at all the airports. Health Care is certainly unconstitutional in America, though in Socialist constitutions like India, China it would not be unconstitutional, but nevertheless bad for the economy, and the poor people in particular.

@GtheMVP I totally agree with your sentiments, Gov't sucks us dry. To me the problem is that there is no real seperation between the Gov't and the State i.e. betw the self-serving politicians and the social structures that belong to the community in common (police, fire, social welfare etc). I fully support the latter but the former is corrupt beyond recognition. Its like damned if we do, damned if we don't...

@GtheMVP - but since we all need healthcare wouldnt it be easier if it was provided with it by default. Like from the day your born u dont have to worry about getting treatment when you are sick, u know you can just walk into a clinic and u'll get treatment no questions asked? And its not really like they taking money that would otherwise have been in our pockets cause we would have had to pay for private insurance with that money anyway... perhaps Im not seeing something?

First, pro-lifers are not against "control of your own body", they are for the right to life, liberty, and the pursuit of happiness. Second, the mandate is done through the IRS, so it counts as part of your taxes. Generally, when you dont pay your taxes, you go to jail. Lastly, the healthcare law is unconstitutional under the 9th and 10th amendments (powers not granted to the government in article 1 section 8 belong to the states and to the people). Try reading those two ammendments TYT
