But we may never kill him. Because then, we are as him; murderers.

You cannot read the old testament and skip the new testament. God created strict rules, which the jews had to follow up. in Jesus there is no law anymore. The Old testament points at Jesus. When He comes; listen to Him. It says. - That verse about casting the first stone says it all. Which right do we sinners have to kill sinners and to judge over sinners?

But The 'criminal' is a human being and therefore he must have the opportunity to think about his acts. So that he can ask God for forgiveness, even if he remains locked. - Killing a criminal, is a primitive, childish way of solving a 'problem' and it creates a new problem.
You can find evidence for and against the death penalty in the Bible, so stop abusing the Lord's teachings to support your political beliefs! Support Capital Punishment and don't let murderers and rapists be praised and protected.

Police decide the life or death when someone pulls a gun on them. They can let them shoot them, or kill them on the spot. Hitler killed 12 million people in death camps alone; he deserves it for such a crime. Serial killers decide this.
No one has the right to make such a choice. If someone would point a gun at a police officer, he already made a choice, a wrong choice and not his to make. Hitler did not kill the actual 12 million, he gave tasks. The soldiers in the camps made the actual choices. Their responsibility. They have to explain it to Jesus. -

Jesus was killed by injustice. He was innocent and chose to be treated like a criminal. Because of His love for us.
The death penalty cannot produce life, it takes life. So it`s not as fertile as you describe.
