Never, ever do the roadside tests. The walk and turn....Sorry officer I have bad knees.
Watch the pen..... Sorry officer you are not an eye doctor and I am not well today. Blow into the PBT... I do not consent officer. Also I am not using the State License to Drive, I am Traveling home in an automobile since my car does not meet the definition of a motor vehicle.
As a Cop, I love Dial DUI Don Ramsell. He makes me better at my job. If I have an answer for each one of his defenses, then I know I have a good DUI. I hope to meet him someday in court.
We are losing our rights. YOU don't throw people in jail unless they have harmed somebody or have some repeat offenses. This business of safety checkpoints is unconstitutional. READ the 4th amendment. Awhile back a man in PA went to see a doctor and he told the doctor in the ER department that he was a heavy drinker and the doctor turned in him to the police and they gave him a DUI without even catching him driving! Its nuts! THIS must stop.
Always remember people, DUI is NOT ALWAYS THE SAME AS DRUNK DRIVING. A DUI can be given to someone just at the limit, just above the limit, below the limit or 5 times over the limit( by then youre likely drunk though ) . Driving "under the influence " is called that so people who are not considered drunk or impaired can be charged just as much as a truly intoxicated driver with no business on the road.Doesnt sound fair to me, does it? Push the limit up to target ruly intoxicated drivers,
In the city where I work, when the suspected drunk refuses to do anything, we draw a search warrant for blood. The suspect is taken to the hospital, blood is drawn, and taken to jail. Soon after, it is set for trial. The suspect faces a license revocation.
Why aren't they placing illegals in jail for drunk driving and exporting them back to Mexico or elsewhere? They are so concerned about a DUI but allow illegals to rape, murder, drive drunk and don't do a damn thing about it..mostly democrats who want illegals here. And then what about the over 100 million Americans who take prescription meds which impair driving? They are trying to stop everyone but have not yet figured out how to do it. If you dont' harm somebody then leave em alone!
3, 000, 000.00 This is the cost for a 99 years to life sentence for D.U. in Texas. Now the prisoner is going to work for lets say for..25-48c per hour, the CORPORATION of that prison will sell furnitures and other goods created by the sentance person for thousands of dollars-So who is the winner here?. So what I am saying is WE NEED TO FIND ANOTHER WAY TO DEAL with this rubbish business. PERIOD
Tea Bagger politicians are getting the legal drunk limit pushed back to 0.22 % to be considered drunk. Tea baggers realize how bad stopping people from going out and enjoying themselves is hurting small business. Driving with a buzz is good for American business acording to Montana politicians. Seems dangerous to me to go in this direction although good for business it would be.
@jobedied WRONG....I'm a Tea party person and I am not for this DUI BS as WE the people go by the 4th amendment rights and its us who want this stuff stopped. Get smart and realize its democrats in California who are running the show and making it very difficult.
@Marksnotebook no it is not tea baggers or democrats its wall street ,banking , and some well placed politicians
Who control a lot of what goes on pulling all the strings. A few stupid politicians from either party stir up all kinds of things to keep folks off balance as we are robbed legally. Drunk Driving is another issue to keep the people arguing over stupid things that will change little.
@Marksnotebook no you are wrong there is nor a hair breath difference between democrats , republicans, and tea party both parties carry the water for the bankers and corporations. It was Reagan and Clinton who allowed the world economies to be stolen by the derivatives markets by undoing all regulation in the name of free markets. Turning the world economy into a gambling casino controlled by bankers. And the populations of the world are reaping the rewards of this failure.
@jobedied You're ignorant---to suggest we should just forget about the constitution and the Bill of rights is a typical radical liberal response. Everyone with a brain in their head knows the economy is sickening today under Obama and we are losing our rights all over the place. Its people like you who need to get out and go to Europe as you're nothing but a damn anarchist who likes chaos and big government.....

@jobedied The Tea party people I know are for the 4th amendment which says no search and seizure without a warrant. Quit trying to say conservatives are doing all this...in IL the democrats control the state and it has some of the most god awful DUI laws in the country. This is not a right verses left issue anyway...its a constitutional issue.
@jobedied Again it is democrats in the state of IL who got the damn legal limit to .08 back in the later 80s. lol........you dumb liberals.. ...California has some of the damndest DUI laws that disobey the constitution (yeah there I go again with our constitution which you liberals hate) and its all democrat with a few exceptions in the outer rural areas. Good grief liberals are so ridiculous.
@espakor How about all the drunk driving by Illegals which last year was about 4200 illegals who drove drunk and killed somebody? In the US about 14,000 deaths happened from DUIs but that figure is deceiving as it accounts for all deaths as in a drunk pedestrian who wonders into the road and gets hit by a car. We should focus on the people who have a problem with drinking and NOT social drinkers who have never had an accident, never had a criminal record, and are innocent.
I have Autopass 2000 and highly recommend it. It's great! I've used it several times and it worked everytime. This cop sounds like a liar, like most cops, and this kit tells cops to go to hell. It allows you to keep on pounding beers and keep on driving, to the next bar or where ever.
Field Sobriety Tests are a bunch of crap. They are rigged in the cops favor to bust anyone they please. The breathalyzer test are BS too. Also, the BAC levels (supposedly indicating intoxication) have been drastically lowered over the years to create more criminals out of innocent people.
interesting concept. but if you get arrested anyways youre forced to give a chemical test at the station which would bring out the truth of impairment. but this certainly minimizes the legal damage to the suspected DUI.
IT is not your right to drive.it is lisenced. to drive on a government road means use of government property and the agreement to follow any rules and regulations there-in. you don't have to be arrested to have implied consent applied. you just have the right now to have it done road-side. it states that by driving. you consent. refuse (in Florida) they take your liscense for 6 months to a year anyways. best idea ever! Course my opinion is bias. I've seen a man cut in half by a drunk driver
@JoshFritz561 Sorry for your situation, but in this country , there are supposed to be limits on what the government can and cant make you do,military or employment being the exception, regardless of whether or not its a liscenced activity,as no one can or should be forced to incriminate themselves,as in if someone was truly intoxicated enough to not be on the road, there shouldnt be any doubt in an officers minds and self incrimination wouldnt be a factor as the officer should have probable cause
Respond to this video... to conduct a field sobriety test , and if a person refuses it,then you should be able to draw blood/urine.But the fact that the limit is so low today and the fact that you dont even need to be above the limit to get a DUI, this makes me believe that the whole field sobriety testing process and what they define as probable cause to conduct them needs some major overhauling. But then the courts wouldnt be raking in the cash now, would they.....
When I was pulled over in America the cop wanted FST. I refused and said : " I'm no circus clown and stand on one leg " He arrested me. But since I hold a German license he could not take it since it has no impact in Germany. I had a rental car and they charged me with dui since at the station I blew .18 and had to appear in court, but never went. Tourists to USA have to go back home to work and was on vacation of 2 weeks and court date was 30 days after arrest. No time for that nonsense.
So the lawyer at the end basically stated that the rights of citizens are more important than the life of an individual. How bullshit of an explanation was that? If you aren't breaking the law you have nothing to fear, I honestly can't believe people can break the law and feel that they should get away with it.
@TheLifeAquatic3 Ben Franklin said "Those who choose safety over liberty deseve neither." And it's not true that only those who are breaking the law have to fear. The cops can arrest innocent people for dui if they don't know their rights.
@vaguy78 implied consent has nothing to do with the field sobriety tests. Implied consent means that once you're arrested, you need to take the chemical test at the station.
Wonder if any of this stands up in Texas?
