Murder is "killing unjustly". While we kill many different animals for food, it is just because it is for food. But we are prohibited from killing fellow man for unjust causes. The State, however, has the right to kill gross criminals, but the state does not "murder" the criminal - because it is just and right for the state to take vengence on society's behalf. God instituted law, and capital punishment. When God commands us to kill rapists (in the bible) it is just, and therefore, NOT murder.
