Is Brain Damage a Good Alibi for Violent Behavior?

I understand the reasoning. But we can not afford not to penalize the violent person even though he has brain damage. We have to change our perspective on this subject. We can use the word safety precaution instead of penalty. And we can completey reform our detention systems towards sustainable, gentle and educational handling of prisoners and patients in closed door pyschiatric institutions.
