On a legal traffic stop (where a person is stopped for a violation) it is legal to preform a dog sniff as long as the person is detained for a reasonable amount of time for a traffic stop (Source: Illinois v. Caballes). On a checkpoint like the one in this video a dog sniff is clearly illegal. (source: City of Indianapolis v. Edmond).

The standard based on Illinois v. Caballes is that a person can be detained no longer than it takes to write a traffic ticket. I think that is a vague and stupid standard, but that is what the standard is.

It seems that the Illinois decision violated precedent to me. That's just an example of how twisted the law can be. None the less, that's the law.

@snarky77005 If I recall, cops can introduce a drug dog into a traffic stop, but the dog arrival better be quick because SCOTUS has ruled that the time of the stop has to be within the scope of the stop. So if you were speeding, courts consider a 15 minute time to be needed to conduct the stop. Any more time and the dog stuff will likely be thrown out since a dog was not within the scope of the stop.

You're correct regarding standard traffic stops based upon probable cause yoyo762. Suspicionless checkpoints are a different matter though. The Supreme Court has only upheld the suspicionless seizure of individuals inside vehicles when all traffic is being treated the same, the scope & time frame of the seizure is very limited, there is no individual officer/agent discretion & the scope of the stop does not include general law enforcement issues or drug interdiction.

dude you should look up 287(a) (3) it states that they are allowed to perform their duties up to 100 air miles from the border. Not miles on land from the border but air miles. So you might want to double check your source of information instead of making video clips to show everyone what your interpretation of the law is. Besides that if you look up the stats that these checkpoints incur you would thank them. Lots of illegal immigrants and drugs come up through theses checkpoints.

I was dehydrated, dazed, and panicked, they unlawfully searched me and were very intimidating. in a duffle bag a very small amount of marijuana was found in a medicine bottle that i lost and forgot about 2 yrs ago. i dont even smoke. I was told i was under arrest and going to jail i was very confused and scared.
I am sometimes slow in the head and have a hard time sticking up for my self, they were like bullies and took advantage of me. I signed a paper I was dehydrated and scared. I was strip searched naked(i heard them say 'shes gonna tell Alex Jones about this'), photographed, finger scanned, and held in a cell I thought i was going to die. I asked for water and to call my friend and was denied. Till the sheriff showed up they were nice to me. I just got a citation. Now i have a 530 fine i am angry.

The only SCOTUS cases upholding exterior drug dog sniffs are those where officers had probable cause to initiate a traffic stop. Suspicionless checkpoints are completely different legal entities & must be limited in scope and the initial detention must be very short in the absence of consent or pc.
In this case the agents ignored the immigration mandate to detain to look for drugs. Quite illegal!

This wasn't a border crossing mapache11. This was along an East-West public highway over 40 miles North of the border and never intersecting the border at any point. Unlike ports of entry where agents have far more leeway regarding what they can & can't do, at this type of checkpoint agents are only allowed to briefly stop for immigration related questions. Drugs searches are illegal here.

On a legal traffic stop (where a person is stopped for a violation) it is legal to preform a dog sniff as long as the person is detained for a reasonable amount of time for a traffic stop (Source: Illinois v. Caballes). On a checkpoint like the one in this video a dog sniff is clearly illegal. (source: City of Indianapolis v. Edmond).

The standard based on Illinois v. Caballes is that a person can be detained no longer than it takes to write a traffic ticket. I think that is a vague and stupid standard, but that is what the standard is.

Edmond decided in 2000 says that the police cannot use a police dog at a check point w/o probable cause, but Illinois v. Caballes decided in 2005 says that police can use a police dog at a traffic stop with no probable cause that the person is transporting drugs. It seems that the Illinois decision violated precedent to me. That's just an example of how twisted the law can be. None the less, that's the law.

@snarky77005 If I recall, cops can introduce a drug dog into a traffic stop, but the dog arrival better be quick because SCOTUS has ruled that the time of the stop has to be within the scope of the stop. So if you were speeding, courts consider a 15 minute time to be needed to conduct the stop. Any more time and the dog stuff will likely be thrown out since a dog was not within the scope of the stop.

You're correct regarding standard traffic stops based upon probable cause yoyo762. Suspicionless checkpoints are a different matter though. The Supreme Court has only upheld the suspicionless seizure of individuals inside vehicles when all traffic is being treated the same, the scope & time frame of the seizure is very limited, there is no individual officer/agent discretion & the scope of the stop does not include general law enforcement issues or drug interdiction.

Reality is still confusing you I see 1942786. I'm not detaining myself. Armed Border Patrol agents who can't find the border they're paid to patrol are detaining me. The fact that they wave me through within a few minutes should be a hint to you that individuals aren't required to answer questions under such circumstances. Nonetheless, if it makes you feel better, by all means drive through these checkpoints all day and answer their 'simple immigration questions'.

My wife and I rode through one of these checkpoints, and after asking multiple random irrelevent questions asked if I would open my trunk, I asked "why?" politely, he then ordered me to get out of the car, said "You are being combative, and we have an 'odor indication'. oh and the reason that the agent did not ask you questions pertaining to immigration is because everyone knows people like you who come through the checkpoint holding there little cameras and throwing a hissy fit on why they have to stop and that these checkpoints are illegal before they even get to ask you a question about immigration. dude you should look up 287(a) (3) it states that they are allowed to perform their duties up to 100 air miles from the border. Not miles on land from the border but air miles. So you might want to double check your source of information instead of making video clips to show everyone what your interpretation of the law is. Besides that if you look up the stats that these checkpoints incur you would thank them. Lots of illegal immigrants and drugs come up through theses checkpoints.

They place stringent limitations on 287(a) & make it clear they need consent or pc to do anything other then make brief immigration queries 1942786. 29 yr old F from CA and I came to the el paso tx drug sniffing dog checkpoint and was ordered out of my car. I have an infowars sticker. I was hysterical and swore i had no drugs on me. I was dehydrated, dazed, and panicked, they unlawfully searched me and were very intimidating. in a duffle bag a very small amount of marijuana was found in a medicine bottle that i lost and forgot about 2 yrs ago. i dont even smoke. I was told i was under arrest and going to jail i was very confused and scared.

I am sometimes slow in the head and have a hard time sticking up for my self, they were like bullies and took advantage of me. I signed a paper I was dehydrated and scared. I was strip searched naked(i heard them say 'shes gonna tell Alex Jones about this'), photographed, finger scanned, and held in a cell I thought i was going to die. I asked for water and to call my friend and was denied. Till the sheriff showed up they were nice to me. I just got a citation. Now i have a 530 fine i am angry.

Here in Austin, TX they have, "DUI Checkpoints." While the courts have ROUTINELY said "checkpoints" are NAZI and ILLEGAL, "DUI Checkpoints" are somehow okay. It, of course, does not matter that they will and have busted people for any reason they can find at these DUI Checkpoint, they call it a "DUI checkpoint," instead of a "checkpoint," and that somehow makes it okay.

@FreeinTX: I wish our sheriff would say something like that publicly. I'd publicly challenge him to back his beliefs on the condition that he personally pays all costs and expunges all arrest records when I prevail in court.
After all, if he truly believes he knows more about law than State v. Holt, 887 S.W. 2d 16 (Tex. Cr. App. 1994), then he would never have to pay...

Good for you sir! You are a true patriot. Keep up the good work on protecting your 4th Amendment rights under the Constitution. There have been forces at work for a long time whose main goal is to destroy the Republic. Sad thing is most of these Border Patrol Agents are probably Mexicans. Ain't that a slap in the face!
