Governments are empowered by the people today to make laws. These are not "fiction" but derive from the process of government, a necessity for people living in a country. But I don't believe that government can declare who is god, because only God can do that.

I don't think a democracy can be considered a fictional legal system, because its laws are derived from the consent of the governed, at least, that is how it is supposed to be. Religion is another matter. Voting on god is not going to help finding one.
