I know we operate under the presumption of innocence within our own legal system, but I can understand why special exceptions have been made in the case of these detainees. It would be logistically impossible to gather the information necessary to incriminate these detainees.

I'm so glad some sanity is returning to this issue, and the political grandstanding and macho chest beating for the benefit of Bush's hard right base is no longer a priority.
It's great they're looking at releasing those who are obviously innocent.
Of course the good friends of the Bush family and other oil barons, the Saudis, negotiated the release of actual guilty people in return for western hostages being held and tortured on false charges.

In that scenario it should be tried by the courts of that jurisdiction by his own peers whether that is against the law. But if you have the evidence, then charge the prisoner with a crime and give him justice. Due process.
