  • Whats up libatards?? Obummer kept it open! LMAO!! Ignorant sheep voters!

  • Please Read: Her Name is Ms. ANN, on YOUTUBE. It tells the whole story. Listen to James Manning. It will change how you think!

  • Butt pyramids does constitue torture, maybe abuse, but not torture. Neither does putting a bag over a head or a barking dog, abuse yes, torture NO.

  • so its not "innocent until proven guilty" no more...?

    oh..but of course not...

  • Obama had better do something.. and not just shuffle the puck to save face.. its his job as our President to enforce the law of the lands.. Either hold trials or issue pardons.. either way it Must be done.. Our Great grandparents, parents, and brothers and sisters are dieing or have died to protect Democracy and our Constitution.. if our current President does nothing than he's just as guilty for not abiding to the laws he swore an oath to.. IMO issue a pardon's and move on..

  • Can we now get on with the trial of Bush & Cheney?

  • They deserve prison sentences!

  • who, lawyers?

  • No proof means your innocent. OJ Killed his wife but the evidence was no good. Hence innocent. Its really that simple. I can't detain someone forever on suspicion.

  • And that's all we need to know. And to keep them jailed It's illegal.

  • You are going to tell me that a judge said a guy who had 400K and a cache of a-k 47s is not under suspicion. That is absolute baloney. He can't make that statement either.

  • It can be all suspicious you want. He could be a drug dealer, anything. No proof, no accusation. You can't arrest somebody for 5 years, torture him and shit based on suspicion. So what if a saudi prince orders that any American caught with weapons or drugs should be tortured, because this nigga looks suspicious! LMAO see my point?!?

You can't transport someone from their country to a illegal facility and torture his ass because he looks suspicious.

  • Exactly. It's ridiculous.

  • Shepherd Smith is too smart for Fox.

    They'll probably fire him.

  • How about this, if they quit cutting peoples heads off (just for the camera's, not even for information), we will quit pouring water up their noses. These people are taking advantage of every weakness this country has, and now they are targeting your bleeding hearts. I don't doubt there are innocent people in gitmo, but there are innocent people in regular prisons too all over the world. It's the price of security. If you have a better way say it, don't just bitch about the way it is.

  • You shouldn't be scared of muslims, they are just cavemen compared to the evil behind your government and corporate/banking elite that run things and keep you slaves. Don't forget, the CIA owned bin laden before he became "number 1 wanted" , -- do you really think they even want him captured? What better way to keep the American public scared and willing to accept that freedoms are lost in place of "NECESSARY" security.

  • In some cultures they do shute with guns at weddings, there has been some terrible accidents during these shutings, that are intended as a celebration of the wedding. So im for stricter gun control in Pakistan. Or you-name-it-stan

  • What an idiot it is not odd for Pakistani to be armed and have money at a wedding. Guns are a necessary evil in Pakistan, in fact it the world's largest custom shop firearms. As to large sums of cash it is a wedding for Pete's sake!

  • 7 years.... sounds like a law suit... American better cover up this crime.

  • This is exactly why it is childish and foolish to compare the international battlefield to police work.

When people are - or about to - shooting at you, it is impossible to collect evidence.

We should have followed the Geneva convention and executed those punks in Gitmo years ago.

  • Fox is dirty, Shep is to me the most fair of the bunch tho.

  • this shows how fighting terrorism SHOULD be more about police/detective work rather than army.

  • Ironically......from what I've heard about Afghanistan at least, it's not so unusual to bring a bunch of cash and an AK-47 to a wedding party - It's quite typical to fire a few dozen rounds into the sky in celebration. I'm not saying he's innocent or guilty...but strangely, his excuse may be more plausible than we think.

  • if that happens to be true, then i must say it's interesting that the cultural difference is so large. to the average american, guns and money would definitely indicate some sort of illegal activity ... or a member of the set of an mtv music video ...

  • lol since when is it a crime to have money and a gun? If that is so many Americans better be fearful!

  • It's going to take a long, long time to undo the damage caused by people like Cliff.

  • Pity Shepard Smith didn't gain any commonsense during the Bush administration.

  • "Pity Shepard Smith didn't gain any commonsense during the Bush administration. "

He is Swiss in neutrality compared to most Fox fuckheads.

  • What the hell happened to Sheppard Smith? Has he grown tired of the BS at the network or something? Nice to seen a sane voice on Fox

  • It seriously is :) He's taking names over there!

  • I am actually still amazed Shep Smith is on FOX news.... he has a brain. If they let him go CNN better pick him up.

  • hated fox for years now but sheppard starting to grow on me :S not sure if i should be scared lol

  • Keep in mind that if some other country came and took a paster off the streets of our country and held them in a prison for 7 years it would be an international incident. I guess sort of like the 50 hostages in the 80s, or all the American hostages taken over the past 7 years in Iraq.

  • That is not the case. If these people are "innocent" why is it that their own countries do NOT want the back? Where you are arrested has nothing to do with whether or not you are guilty.

  • This is crazy... people are incarcerated for years and tortured without evidence or proof... and Bush and Cheney and others walk around free, when there is proof of their illegal activities. How come those people responsible for wrongful imprisonment and illegal torture arent being dealt with? Where's the Geneva Convention and the UN now? I guess the US is an exception...........

  • of course the US is an exception. So is Great Britain, China and Russia. They have the most power in the UN. You can't do anything without them

  • This is just the tip of the iceberg. Children as young as 8 and routinely in their teens were raped in front of their parents. Girls & boys raped in front of their fathers and mothers to induce coercion. Women raped & tortured so badly that many women strapped bomb making materials to their chest to be exploded in populated marketplaces in Iraq at the authorization of CIA. These people need to be locked up!!

Screw the memos we need to see the videos. Memos are what you give a secretary!

  • I don't know anything about Cliff May, but he makes a legitimate argument. I know we operate under the presumption of innocence within our own legal system, but I can understand why special exceptions have been made in the case of these detainees. It would be logistically impossible to gather the information necessary to incriminate these detainees.

    Essentially, my argument is this:

"You gotta do some serious shit to get yourself locked up in guantanamo."

  • TheNoel, your argument would be false, since over 80% of Gitmo detainees were SOLD to us by Pakistanis and Afghanis for bounty, and only 8% of Gitmo detainees are categorized as Al Qaeda soldiers. Did you not hear the fact that the guy that was just ordered released was picked up from some prayer house, not on the battlefield? How would you like it if some homeless guy busted into your church, gave you over to the police calling you a thief simply to get money from a bounty on thieves?

  • @technicschic

I'll just be frank, and admit that I'm too lazy to find contradictory statistics. As for your seemingly rhetorical question: I'm just glad we belong to a country in which such a thing would never happen.

    Bonus question:

Why aren't these detainees being taken back by their respective countries of origin?

  • TheNoel, you won't really find many contradictory statistics, because these statistics come looking at the actual Gitmo files. The info from those files, including where they were picked up and whether they are categorized as Al Qaeda, comes directly from the government itself. The detainees aren't being taken back by their respective countries right now because of the stain of Gitmo on them - Cheney talking about how they're the worst of the worst has created problems for them.

  • Again, they have the "stain" of Gitmo on them - Cheney's words are just one example. Like I said earlier, over 80% were sold to us for bounties, and it is very likely that the ones we want to release have not taken part in any wrongdoing (hence the reason why we want to release them)

  • uhmmm everytime a warlord/dictator/general either from africa or from the balkan war is put to the international court of justice, they are held because there is proof of their crimes and usually they are picked by an army .. Cliff May talks bullshit

  • Cliff May is a jackass.

Anyone catch his interview on the Daily Show?

    Wow...

  • fox are anti American, because they like to bad mouth their president. The terrorists must think its quite hilarious!

  • The first Fox News presenter with some brains.

  • Cliff May is a war criminal who has argued for torture. Google it

  • In America, you have to have evidence to hold someone...and even then they have a right to a speedy trial. Well, if you don't have evidence against a person, you can't even bring up charges...who is defending you? It's Bullshit, and it has to stop. If you can't file charges, you let a person go.

  • Stock market doing good lately ?

  • Shep Smith is the Bomb!! anyone agree??

  • Yes, when it comes these kinds of things. But Shep's still a right wing Fox mascot when it comes to economic policy.

  • Yeah, I hate fox and I dont agree with Shep on most thing, but at least he got integrity, which is rare not only in the media also by most people I interact with.

  • It's just a lefty righteousness theatrics, given the rest 99% of the Faux coverage being a complete right wing xenophobic Hoax.

  • Search Shep Smith in youtube.. he's pretty much anti-matter on Fox News. He doesn't repeat talking points and has a brain.

He's the guy that mocked Glenn Beck, called Bill O'reilly biased to his face, told Republicans that "We do not torture", defended New Orleans against Sean Hannity during Katrina, and on top of that he's a pretty cool guy.

As a Dem.. Shep isn't an evil guy.. he's probably the only non-biased guy on Fox News. (I have my doubts about Colmes)

  • From what I see, Shep is actually an Independent.

At least FOX "News" has ONE man with integrity.

(Except when he was talking about J-Lo and Blow Jobs. lol Look up "FOX News J-Lo Blow Job" here and see what I mean.)

  • glad to see I'm not the only one that caught that I think he may leave fox soon lol.

  • They don't want to follow the law

  • Thanks! The gay at fox is the only sane one!

  • I'm so glad some sanity is returning to this issue, and the political grandstanding and macho chest beating for the benefit of Bush's hard right base is no longer a priority.

It's great they're looking at releasing those who are obviously innocent.

Of course the good friends of the Bush family and other oil barons, the Saudis, negotiated the release of actual guilty people in return for western hostages being held and tortured on false charges.

They are the ones in the recent 'terrorist films'.

  • ha I love Shep!

  • RIDICULOUS!

$400,000 IS evidence in the context of an extremely poor neighborhood, moron!

And saying that soldier aren't detectives is no excuse and is a pitiful failure of the Shrub Administration: if you're going to imprison somebody, you need to figure out if there is a reason: not just because somebody fingered him. The motivations behind pointing the finger are varied, and often not with good intentions.

  • Shep is definately on his way out. imagine if it was hannity talking with those 2 guests. . . . anything, and i mean anything the guy on the right said he would reframe and throw it at the guy on the left without even thinking about it, im certainly not a "shep" guy but kudos for him for actually making the segment somewhat different from everything else on fox news

  • Shep is a pretty good guy on this issue.

  • "these are soldiers, not detectives"

Therefore guilty until proven innocent? I think not, Mr. McDoucheington.

Anyway, are you to tell me that no one has thought to put a video camera on a helmet? Come on now. We have stealth robot bombers but you can't stick a 30 dollar camera to a helmet with some duct tape?

  • Shep Smith, kicking ass and taking names! Mark my words: His days at Fox News are numbered. Roger Ailes will not tolerate dissent from Fox News anchors. Hardcore neconservative religious fundamentalists only!

  • No evidence? Jail him!

    What would the founders say?

  • i saw that cliff may with john stewart the other day,

    he is an uber-nazi,,,

  • Have we for gotin about 911.

I can only hope that we wake up befor we see that agin. But it don`t look like it

  • Obama's 911 will be an Inside Job.

Obama wants to invade and occupy Pakistan as well as Iraq and Afghanistan. His handlers just want to nuke Iran though.

You will be happy when they nuke Iran won't you?

  • One question:

What in the world are you talking about?

Relations between the US and Iran are improving.

We can't even handle two wars with our current military and you think he wants to invade Pakistan? And we already are in Iraq and Afghanistan.

Sorry for the tone, but it just is so far fetched its amazing.

  • Oh don't worry, Rahm Emmanuel wants us to "serve our country" - mandatory - just like Rahm Emmanuel served HIS country - Israel.

Sorry for the tone, but AIPAC and Rahm Emmanuel already have figured out to get Pakistan, Afghanistan, and Iran - bad economy plus another terrorist attack equals a perfect environment to send Americans to fight and die for middle eastern interests.

Are you even loyal to the USA? You a big fan of HGIC Geither? RIH

  • Did that guy just say it is okay to hold suspects without evidence?

  • Pure comedy.

  • "We don't have proof."

If you don't have proof then you have no right to hold someone. Period.

Republicans love to talk about how we're turning into a fascist country, or an oppressive regime etc etc....

So, holding people without evidence and no trial... that somehow makes us a free and moral country?

It's sickening how low of a standard some Republicans are willing to hold this country to just out of political posturing.

  • haha we are at war man, this isnt l.a. law or Night Court, you dont need proof in war remember we are at WAR i know most americans are completely blind to whats going on outside our borders , but we are and american men and women are being killed and they sure the fuck dont give us fair trials or hold us in nice "gitmos" they cut our fucking heads off

  • Shepherd Smith doesn't belong at Fox -- it makes too much sense.

  • i quite like that shep smith guy. he's like the only dude at fox that has a soul.

  • It's not Gitmo that can't catch a break anymore, it's (hopefully!) cheap-assed rhetorical tricks and demagoguery that are getting called more often by responsible TEE VEE talk show hosts.

If you MUST bring on two opposing view talking heads, set them up in a shouting match, and pretend that it's an honest "debate" the least you can do is be responsible on refereeing the bullshit. Make arguments, yes, but without cheap rhetorical tricks.

  • If you dont have evidence suporting a conviction you have no right holding people.

Its Innocent untill proven guilty not the other way around!!!!

Its just WRONG to hold people like that without charge.

  • thats the thing though enemy combatants also have rights afforded to them by the geneva convention which we are supposed to uphold.

We've basically took the geneva convention and wiped our asses with it.

But we have the gall to talk shit to other "terrorist" countries

  • The Geneva convention cannot really be applied to the war on terrorists. Maybe another convention should be held and new rules adopted for the world of today.

  • like the war crime tribunal maybe? Although they would wiggle out of that because they haven't classified the Guantanamo inmates as prisoners of war. (and the US hasn't ratified it)

  • @Korilian13

    witch = salem

    commie= cold war(McCarthyism)

    terrorist = war on terror.

  • cliff, i hope u fall off your name!

  • Again I have to say... WTF happened to Shep?! He just keeps surprising me... keep it up!

  • Is Cliff May retarded? Of course they aren't going to show you the innocent people when you go to Git-mo. They are only going to put the obvious terrorists on display. If they have any, that is. Fear-mongers like him are what is causing so many of the problems in America.

  • Dude. Shep is such a badass. Why is he on Fox news? Like...it doesn't even make sense.

  • I know right hes like the only sensible person at that station

  • Right wing lunacy in a nutshell-'the courts haven't proven them innocent they just haven't proven them guilty'. Obviously this nut hasn't hear of 'innocent until proven guilty'. Or he has but he just doesn't care about it.

  • WOW Shep!

Maybe Clif May is a Terrorist, we don't know let's lock him up for 7 years and find out

  • and water board him to be sure

  • can't be too careful

  • Smith---my favorite pundit head at FOX.

  • Guilty until proven innocent. God bless America.

  • 1:08 Way to go with the Straw Man argument Cliff May.

No, Shep shouldn't let you talk when you're not being an honest debater.

  • shep's sweet

  • AK47s at a afghan wedding is like bringing champaign to a American one.

  • ya, im from yemen and people always carry Ak47's to weddings and special occasions. its a cultural thing thats supposed to represent that a man is able to protect himself, his loved ones and his property.

  • hey fool! please. were not interested in your bs lies

  • maybe instead of being ignorant, you go and actually check your facts first. We dont live in the same place. They have their own culture and we have ours. I was born and raised over there and every wedding they ever had, there were always men with AK47's with them. When you kidnap people and torture them for 7 years, they will resent and dispise you. Then you will create someone who will want to take revenge on what you do to him or to his people. thats how terror is born.

  • ♥ Shep.

  • So... which of these three loud bastards am I supposed to be agreeing with?

  • Comment removed

  • Innocent until proven guilty. If they don't have proof, what does that make them?

  • Gee, I don't know....maybe we should have waited, followed them, and watched while they used their machine gun on innocent people. If you packing that kind of money as well as a automatic weapon....

  • In that scenario it should be tried by the courts of that jurisdiction by his own peers whether that is against the law. But if you have the evidence, then charge the prisoner with a crime and give him justice. Due process.

  • If having a lot of money and automatic weaponry was cause enough to arrest people there wouldn't be any Republicans left on the streets.

  • Damn, this video almost made me feel sympathetic to Shep "Curbjob" Smith.

  • assume guilt until proven innocent?

  • Ak-47s are VERY common in Afghan weddings, oh my god is our country FULL of ignorant fools??????

  • Since we don't need evidence to put people in jail, let's put this loudmouth asshole in jail. I think he might be a terrorist.

  • Better yet, let's put Olie North in GITMO. After all, he fits the profile. Found in Afghanistan near a blown up village, not in uniform, disseminating propaganda. Lock him up until he either confesses to being a terrorist, or becomes so bitter and hateful that he's too dangerous to let out, even if he WAS innocent in the first place. Problem solved.

  • I second that

  • "Absense of evidence is not the evidence of absense"

Rings a bell? March to Iraq war

  • The original quote is from a Carl Sagan essay on the exhistance of God. Leave it to Rumsfeld to turn it into an invokation of paranoia as a preamble to an unprovoked invasion.

  • I didnt know that...thanks :)

  • "soldiers are not detectives who collect evidence"

  • jajaja, that Shep is a real idiot... jaja.

  • Watching three idiots like this makes it so clear how the Republicans are feasting on their own insanity. Neocon Cliff May is a loud-mouthed idiot, Shep is an Alien and Juan is a phony.

  • I love Shep. Full fledged liberal/democrat, but Shep really does tell it like it is. He pulls the Faux bullshit on them like they do to the rest of their guests. This is awesome.

  • We don't have evidence, so lets just suspend habeas corpus and detain people for the rest of their lives. I would be really embarrassed if I was a Republican.

  • re: terrence0258

==We don't have evidence, so lets just suspend habeas corpus and detain people for the rest of their lives. I would be really embarrassed if I was a Republican.==

    Worse than that.

Torture is only effective, if what you actually Want, is false intelligence.

GOP: "We don't have a link between Iraq and Al Qauda! Let's round up a bunch of middle eastern people and beat them senseless until they admit that this link exists. THEN we can go bomb the crap out of their country!"

  • Cliff May is a moron

  • History & Science prove the only legitimate information does not come from torture; In fact, an al Qaeda member confessed to al-Qaeda's Deputy Operations Chief Ayman al-Zawahiri location specifically because his captors were decent & fair

Moreover, heads of DOD make case people joined against America simply because of their indecent atrocities at Gitmo; and, that just as many Americans have died as a direct result of those atrocities at Gitmo as have died in the WTC towers!

  • GO Shep!! Im am NOT a fox news/fuax noize fan But Shep at least says the truth now and again. Did I just say that? EEK yup brownie8519 the end is nigh! LOL!

  • Shep is such a maverick..lol!

Good for you Shep, call 'em out!!!

  • Cliff May is a terrorist, hell i dont need proof but lock him up anyway because according to him thats fine. His red white and blue costume is a propaganda tool to show him as an all american expert, only an idiot pr man would wear such hardsell attire. He's transparent and even shep who i cant stand remembers that it should be innocent till proven guilty although according to that et lookalike we do not fucking torture lol

  • Are places like Gitmo an example of human projection by a society?

I submit that Corporations, by virtue of their legal protection scheme, encourage the elimination of compassion on the human level

Thus, a society like America, (which I argue is a socialist country for corporations), is made largely of citizens who daily disconnect themselves from compassion

The net result is a war mongering society that allows torture & violations of human decency!

  • I couldnt agree more, commerce kills community and compassion. I see it everywhere.

    Well put! :)

  • If I keep talking over you it proves I'm right! They wouldn't be in GITMO if they hadn't been doing something, so they must be guilty or not innocent. Simple!

  • exactly...

  • Fox actually being fair and balanced?!..lol..the end is nigh :P

  • mahna mahna
