If you stop them directly "at" the border, they can run back without being caught. That's why we have interior enforcement and fences at cities. There is border patrol at the border, but it clearly doesn't work alone. Illegals sneak in, and load up humans and drugs in truck and take it up the interstate. They have things like tunnels that go miles under our side of the border to resident houses.

Of course they won't. But the reason for permanent checkpoints is they lead illegals to try to drive around them. That's where "tactical" checkpoints come in. they monitor activity on side streets, and find other roads where there is less traffic. There, they could do a much more prolonged inspection of illegals. The permanent ones are just to scare them to run to the tactical ones.

Yes, people do all of those things, but in a free society there is Constitutional Law that the police must obey.
The 4th Amendment of the US Constitution states police may not stop and question or search you without a warrant, signed by a judge, stating what they are searching for; or probable cause.

And yes, Location, in realtionship to a border does matter.
Before you have entered the United States (At the border) a person has NO Constitutional Rights.
The Border Patrol can inspect and turn away anyone they like.
Once a person has crossed the border, that person has the full protection of the United States Constitution...

He was searched and detained for dog keying on the car, or for unusual behavior. Probable cause is the issue.
If you do not think a person refusing all questions and barring themselves in their car when being questioned by law officers is not probable cause then that is a different case.
You are right though the pastor had the right to be escorted back across the border.
If on US soil, had probable cause, location irrelevant. If Mexico, then no constitution, location irrelavent.

The police are NOT even allowed to stop and question a person without a warrant or probable cause.
The framers of the Constitution endured this treatment from the British, so they protected future generations from this sort of unwarranted Government invasion into our lives.

Cops stop and question people everyday in the states. No cause needed thanks to Patriot Act not that it stopped them prior.
If I am stopped as a citizen I must comply with officers. I can not say screw you I am innocent and go on my way. Especially when at border of a foreign country.
If you are a a crime scene for whatever reason, follow instructions, they will force compliance.
