She broke a big rule. Never get out of the vehicle unless the cop asks you to do so. A police officer is NOT required by any law to show you or anyone else the radar readout or video footage at the time of a traffic stop. Allowing this puts the officer, driver and passers by in danger. If you want to challenge a violation then you have to wait for your day in court to do so, such is the way that our judicial system is set up.

This is, along with the video an excellent example of police out of control. Cops used to be smart, caring and mostly sensible people. Not any more. The cop in the video could have handled things much better, in fact assaulted the woman and I am sure traumatized the children in the car. You sign your bond at the bottom of your citation or are released on your own recognizance. During that time you are required by LAW to submit to lawful commands and/or sobriety tests. If you refuse to do so, kids present or not, you will be dealt with as a threat. If you do not like it, do as you are told while you are under arrest.

You must follow "Lawful" commands given to you by law enforcement officers. You obviously knew he was an Officer. You didn't do as instructed and were informed you were under arrest. Once you are verbally told by an Officer, which you also understood, that you are under arrest you are only free to go when you post a bond. Next, the taser is a use of controlling force, not lethal force. It is the same as hitting someone with a baton or tackeling them. It is used to gain control of a situation, not an answer to a suspect with a firearm, so it doesn't matter if she was armed or not.

The suspect does not have to have a weapon for a taser to be justified.
Think of it this way too: The cop told her she was under arrest, and she was trying to get back in the car. She might have a weapon in the car, she might try to flee. Either way, it puts peoples lives in danger.

She broke a big rule. Never get out of the vehicle unless the cop asks you to do so. A police officer is NOT required by any law to show you or anyone else the radar readout or video footage at the time of a traffic stop. Allowing this puts the officer, driver and passers by in danger. If you want to challenge a violation then you have to wait for your day in court to do so, such is the way that our judicial system is set up.

You sign your bond at the bottom of your citation or are released on your own recognizance. During that time you are required by LAW to submit to lawful commands and/or sobriety tests. If you refuse to do so, kids present or not, you will be dealt with as a threat. If you do not like it, do as you are told while you are under arrest.

You must follow "Lawful" commands given to you by law enforcement officers. You obviously knew he was an Officer. You didn't do as instructed and were informed you were under arrest. Once you are verbally told by an Officer, which you also understood, that you are under arrest you are only free to go when you post a bond. Resisting arrest is a crime, the officer was justified, it doesn't take a big person, or a woman, or a mother to hurt someone...even children can use guns, and weapons continue to get smaller as technology advances. I am very involved in law enforcement, and the law must be enforced. Just know this: The one that you hate and despise, may be the one that one day protects you and your family from harm. This is America, and you are entitled to your own opinons, but so is everyone else.

Thank you for writing "tased", it drives me crazy when people say "tasered"...We are very lucky to live in the U.S., in third world countries, there are 4 and 5 year olds running around with AK-47s. It could happen here...is it a little far fetched and unreasonable? Yes. But the law is still the law, and is backed by the same constitution and government system that lets citizens express their comments and disagreements.

The cop doesn't know she doesn't have a gun. I don't care if there's kids in the car or not, anyone and everyone is a potential threat. Especially because the cop has no idea of who they are or what they are capable of.
This lady was resisting arrest and that is why she got tased. If she'd stayed calm, she probably would have just gotten a ticket and gone on her way. Instead, she embarasses herself in front of her kids and set a terrible example.

She could have been getting ready to flee or grab a weapon for all the cop knew. Notice its always the people who dont comply who these things happen to.

several issues with the mom playing the innocent role... while the mom was getting out of the car the cop told her to get back in which she did not, he then instructed her again to get in which she refused, he then stated she was under arrest at which point the mom returns back in the car, the mom then struggled against the arrest. What you don't see is if the mom made any kind of moment while in the van which the cop can take as a threat. People do stupid things even with kids in the car

The fact is, it is an officer safety issue for the woman to follow the cop back to his car. He would be at a disadvantage inside his car, plus, the side of the road is not where you argue your case. You do that in the safety of a court room.
If in fact the cop did not have PC for the stop, he will get in trouble and the case is dismissed. This woman failed to follow directions which were lawful orders. In doing so, she was breaking more laws.

Actually, you just lack situational awareness. He didn't tase the kids, so your line about the kids holding crack and an M14 is pointless.
Next, the taser is a use of controlling force, not lethal force. It is the same as hitting someone with a baton or tackeling them. It is used to gain control of a situation, not an answer to a suspect with a firearm, so it doesn't matter if she was armed or not.
The cop used the taser correctly to affect an arrest

If I did what this lady did, I'd say that I deserved to be tased, but then again, I take responsibility for myself and can admit when I'm wrong.

Try to think about things from the cops perspective. You have no idea what's in the car and she has already not followed several of his directions, like staying in the car.

No actually the officer and the police departments are the ones who lack situational awareness. their policy of tasing anyoone and everyone they feel like tasing simply because they have the authority to do it, is bullshit. commuters on American roadways in violation of minor trafiic laws are not second class citizens who need to be tasered or dragged from thier vehicles in front of thier family members because they didn't immediately kiss the cops ass and follow his orders.

The taser is not an answer to a weapon. If she had a weapon, the cop would have pulled his gun!
The suspect does not have to have a weapon for a taser to be justified.
Think of it this way too: The cop told her she was under arrest, and she was trying to get back in the car. She might have a weapon in the car, she might try to flee. Either way, it puts peoples lives in danger.

This lady had no right to demand anything from a police officer, especially while her children were in the car. She should have had the common sence to be a good role model and accept the ticket and fight it in court and win. About the Taser, she retreated back to her van and would not get out of her car and he had to peel her out.
