@darkshadowssonic Only after Final Haunt-Dark. In GUN Fortress and Black Comet, it makes sense Diablon is there; both scenes before the stages imply it's there (rats running loose on the base=GUN) In Final Haunt though, not only are there no GUN soldiers in the entire stage, Shadow's revelation was based entirely on defeating Sonic, having no malice towards humanity. Shadow activated the shields so no one could interrupt their battle.
