In California, it does matter who was driving; only the driver is responsible for red light camera tickets. This is because California law treats a red light camera ticket as a minor criminal violation, just like any other moving violation. Most other states treat the camera tickets as a civil matter, like a parking ticket.
California's need to ID the actual driver has led to the creation of a unique investigative tool, the fake ticket, or Snitch Ticket. Google it.

Notice the point increase on violations? Who does that benefit besides the state? Insurance companies. Thats worth hundreds of millions a year. Who is watching DMV committee members as they make these increases, many of witch can't be contradicted in court no matter what the outcome? The system is ripe for corruption. We are being fleeced.
