Kagan said SCOTUS should be focused on ferreting out improper governmental motives when deciding First Amendment cases. She has argued that "the governments reasons for restricting free speech are what matters most" and not necessarily the effect of those restrictions on speech. So Kagan is anti-1st Admendment what a great pick Oassbackwards!
