Dan the law you speak of is not LAW..It is an Act and statute given the force of LAW through consent. The human being who was arrested shouldnt have entered into joinder by the policy enforcement officer. The fact that we are being stripped of our liberties day in day out is a very serious issue. The officers have had this power since 1984 (PACE) it's not a "new" power. If he had just provided his name he would have been issued a summons and could have had his say in court. My point was he was only arrested becuase by refusing to state his name he left the officers no other option (can't issue a summons to someone if you don't know who they are)

You have also come to the conclusion that the man committed an offence. How is this compatible with the idea of 'innocent until proven guilty'? What you mean is, if the police THINK a person has committed an offense, then they have the right to demand a name and address. So, it only requires a police officer to say 'I believed he / she commited and offence' and then they have the right to demand a name and address - police state.
