You would judge a person based on the content of their character.
You would judge a political party based on it's performance in relation to supporting and defending the Constitution of it's country.

I think they are using the term "rape" merely as an analogy to the attacks against the liberties WE as Americans enjoy.
Rape is not just a physical attack, it is also an attack on one's dignity. So, they are using the rape analogy to emphasize the degree which they feel these attacks rise to.
By taking the comments out of the context of the larger points being made, one looses those points and brings the discussion to an irrelavant level about a single word rather than what is really important
