Actually if I'm not mistaken that is not the only reason of DOJ, there are many grounds thay are looking at. But looking at what has happened next i don't see that DOJ has really no problem about the Arroyos leaving, in fact they make it in their top list to make sure that Arroyos don't leave the country. believe me!

here's to finally shut you up. when DOJ prevented GMA from leaving the TRO was "suspended pending compliance". which means the TRO was not in effect and the DOJ has the power to prevent GMA under the watchlist order. if there was a mistake in the certification of that "compliance", it was the fault of the clerk of court of SC and GMA's lawyers.. no fault attributable to the DOJ.. so DOJ was justified, the only thing that DOJ violated was the separation of powers i think ;)
which leads us back now that the END does NOT justify the means (no matter how GOOD or NOBLE your intentions maybe). It's like killing someone or stealing a food just to satisfy your hunger. Stealing or killing is still wrong!

And going back to the Constitution, the human rights- the right to life (as far as I know) is the BASIC & FUNDAMENTAL right/s. In other words the rights of many is like a line, and the individual right is the dot that makes up the line. You can never protect the line, without first protecting the dot.

I'm not sure if there are still some, but basically more or less these conditions apply. Other than that, you are FREE to go. Ang guess what, during that time- there's NO case filed yet! So where does it leave you? As a human being you have the right to travel...
It's really just so simple! Human Rights- Right to Life comes first because that is the basic & fundamental right.
TRO- is just temporary, and you're right it's still subject for verfication. You know why the SC release the TRO? Because the Right to Life rules, it doesn't matter whether you are sick or not, seriously ill or not... It is your RIGHT! Every human being has that right and can exercise that right. The only conditions that a person cannot exercise the right to travel (as far as I know) are the ff:
1. If you have infectious/ contagious disease
2. If you are a threat to security (ex. terrorist)

The SC in issuing the TRO has set a condition in the TRO before the arroyos can leave. and that is that they should submit to the court a name of a representative to whom summons will be served if cases will be filed. this condition was not complied with by the arroyos instead they hurriedly went to the airport. so wala na tyong issue.. furthermore may nakafile na din na kaso so barred n tlg umalis

Actually I don't give a damn about the DOJ's motive, and certainly don't care about the Arroyos... What I'm concerned more is the rule of law, and the human rights. Anybody has the right to life, to travel, and to choose any hospital, doctors... he/she pleases "regardless" how serious or mild his/her condition. That is just so BASIC! Of course some conditions apply, but in the Arroyos case there was NO violation to the condition.

Actually if I'm not mistaken that is not the only reason of DOJ, there are many grounds thay are looking at. But looking at what has happened next i don't see that DOJ has really no problem about the Arroyos leaving, in fact they make it in their top list to make sure that Arroyos don't leave the country. believe me!

here's to finally shut you up. when DOJ prevented GMA from leaving the TRO was "suspended pending compliance". which means the TRO was not in effect and the DOJ has the power to prevent GMA under the watchlist order. if there was a mistake in the certification of that "compliance", it was the fault of the clerk of court of SC and GMA's lawyers.. no fault attributable to the DOJ.. so DOJ was justified, the only thing that DOJ violated was the separation of powers i think ;)

And going back to the Constitution, the human rights- the right to life (as far as I know) is the BASIC & FUNDAMENTAL right/s. In other words the rights of many is like a line, and the individual right is the dot that makes up the line. You can never protect the line, without first protecting the dot.

yeah the case was after the incident. but the PRELIMINARY INVESTIGATIONS was before the incident. enough reason to escape. and nobody deprived GMA of her right to life, nor the right to travel. The DOJ simply want to be heard before the issuance of the TRO since PUBLIC INTEREST is involved. if after hearing the side of the people and the SC issues the TRO then the DOJ will comply. DOJ just want the side of the people to be heard. even your right to life can be taken from you (death penalty)

But now that there's a case filed against the Arroyos, it doesn't mean they're already guilty... it's their chance to prove their innocence (if they are innocent)... However until there's no decision from the court, a person is presumed innocent!

TRO- is just temporary, and you're right it's still subject for verfication. You know why the SC release the TRO? Because the Right to Life rules, it doesn't matter whether you are sick or not, seriously ill or not... It is your RIGHT! Every human being has that right and can exercise that right. The only conditions that a person cannot exercise the right to travel (as far as I know) are the ff:
1. If you have infectious/ contagious disease
2. If you are a threat to security (ex. terrorist)

whatever. as it turns out. the DOJ is justified in preventing the arroyos at NAIA. you know why? The SC in issuing the TRO has set a condition in the TRO before the arroyos can leave. and that is that they should submit to the court a name of a representative to whom summons will be served if cases will be filed. this condition was not complied with by the arroyos instead they hurriedly went to the airport. so wala na tyong issue.. furthermore may nakafile na din na kaso so barred n tlg umalis

laimezify, what the DOJ is questioning is not GMA's right to be treated abroad if she's REALLY ILL. the DOJ is invoking the public's right to be heard before the grant of the TRO. do you know the nature of a TRO? the allegations in a petition for TRO is always subject to verification, if youre just lying in your petition, pwde ka makulong. in this case the Arroyo Supreme Court did not even verify, kahit na may medical certificate coming from GMA's doctors themselves na gumagaling na si GMA

Actually I don't give a damn about the DOJ's motive, and certainly don't care about the Arroyos... What I'm concerned more is the rule of law, and the human rights. Anybody has the right to life, to travel, and to choose any hospital, doctors... he/she pleases "regardless" how serious or mild his/her condition. That is just so BASIC! Of course some conditions apply, but in the Arroyos case there was NO violation to the condition.

sa kabilang banda nakakaawa si gloria arroyo.. pero kung iisipin mo yung nagawa nya sa bansa na madaming talagang naghirap malamamng madami din nanumpa sa galit na lang.. mas naawa kasi akokay ERAP lalo na yung pinakulong nya.. siguro iba na rin ang pakiramdam ni gloria kaya gusto nya magaling na doktor,, aba minsan lang ang buhay.. kapg may masamang ring nangyari kay gloria e mababaliwala rin yung mga kaso.. yung mga pinaglalaban natin.

She deserves her position and decision, if people can go directly to SC why not make it so available for all filipinos where in fact reality speaks that not all filipinos can afford the SC.
