The 9th circuit court of appeals in this case specifically ruled that a tribal nation cannot legally act like a gatekeeper along a state highway running through tribal land & has no authority to deny anyone passage on such highways.

This is a total sham. They didn't say the officers had no authority to detain him because this is America and we're free people. It said that they had no right to detain him because he was not Native American and he wasn't inebriated. This court case makes no mention of his right to be free from unreasonable search and seizure. It acknowledges nothing, while seeming to acknowledge everything, thereby pacifying the plaintiff (Mr. Bressi) and accomplishing the goals of the defendant (the gov't).
The ruling from the 9th circuit was limited to the issues brought up in the appeal and reversed the lower court's decision to dismiss the claims.
Now it goes back to the district court where the meat of the lawsuit will be decided. Specifically, where or not the checkpoint violated the Constitution.
The 9th circuit thinks there's enough evidence to justify further proceedings. Otherwise the court wouldn't have reversed.
I'll be writing about this in greater detail on my blog.

Various parts of the Patriot Act have already gone through litigation and have found to be unconstitutional. Google "patriot act overturned" and read the Wiki page on the act for some examples.
While this is a great precedent in more recent days, this story was spun to all hell making it sound as if it were more about tribal traveling rights rather then search and seizure.
I commend you Mr Bressi! I'm sure yours has been an arduous and expensive struggle. Congratulations on your court victory. I acknowledge what you already know, that your actions make us all more free.
