The law is that he was on privet property actually anybody that in not a tribal member is not suppose to be on that land. A tribal member just has to spot someone non-native and call the police and they could go to jail simple as that.

Actually you're wrong kayluz23. I was on state property. SR86, which was ceded to the state by the Tohono O'odham Nation in the 40's or 50's, is a state highway. The 9th circuit court of appeals in this case specifically ruled that a tribal nation cannot legally act like a gatekeeper along a state highway running through tribal land & has no authority to deny anyone passage on such highways.

im from tucson and i hate stopping at the checkpoint near arivaca when im comming from mexico after visiting my family in nogales, they always ask "US citizen" eventhough i havent even come to a full stop yet and before i can say the words "born and raised" they are already waiving me off its a pain and waste of time. they dont even care they are so use to everyone saying the same thing.

The checkpoint is still there 24/7 Mekel343. It's not the same one involved in the lawsuit filed in 2003 but legacy BP & Customs were participants & their presence will play a role in the final outcome.

I have considered filing a lawsuit but they are time consuming & resource intensive which are limiting factors. Unlike govt agents, I/we don't get paid to bring charges against others. Additionally, unlike the tribal police, the BP haven't been foolish enough to drag me out of my vehicle yet.

The lawsuit involves a checkpoint that was setup on the reservation about a mile further West along SR86 then where the current Border Patrol checkpoint is. That checkpoint involved tribal police , Customs agents and Border Patrol agents

From what I hear, enough tribal members complained about Border Patrol harassment on the reservation that the tribe refused to allow the Border Patrol to setup a checkpoint inside the reservation. Consequently, they set it up just outside its boundaries.

the cops know that this is what it takes (a LONG and probably expensive process) and they can use that to "hassle" a person.

even if a person is "in the right," once that person is arrested, he has been "hassled."

This is a total sham. They didn't say the officers had no authority to detain him because this is America and we're free people. It said that they had no right to detain him because he was not Native American and he wasn't inebriated. This court case makes no mention of his right to be free from unreasonable search and seizure. It acknowledges nothing, while seeming to acknowledge everything, thereby pacifying the plaintiff (Mr. Bressi) and accomplishing the goals of the defendant (the gov't).

The ruling from the 9th circuit was limited to the issues brought up in the appeal and reversed the lower court's decision to dismiss the claims.

Now it goes back to the district court where the meat of the lawsuit will be decided. Specifically, where or not the checkpoint violated the Constitution.

The 9th circuit thinks there's enough evidence to justify further proceedings. Otherwise the court wouldn't have reversed.

The lawsuit itself commenced in December of 2003. We've just been arguing for the past six years whether or not I had the right to sue the tribal officers. The district court ruled I didn't while the 9th circuit reversed earlier this month and ruled I did.

A status hearing in district court has been set for September 16th.

I got booked one time while bicycling because I would not give an errant police officer my social security number (after giving him my DL#). First they said it was because I had no helmet (legal), then it was because I had no light (it wasn't dark), and then finally they said it was because I didn't use a turn signal.

The judge (Davidson County) told me I was a smug punk for putting my civil rights above public safety. Would have love to have had a civil rights lawyer with me then . . .

Various parts of the Patriot Act have already gone through litigation and have found to be unconstitutional. Google "patriot act overturned" and read the Wiki page on the act for some examples.
