I don't know, it took them six months just to fix inability to open videos in tabs or windows from the subscription menu and that was an annoyance for every user. The purpose of Safe Harbor is to indemnify YouTube (or similar Internet sites) against copyright infringement caused by users of YouTube. The Safe Harbor provisions essentially make the conflict between the alleged copyright holder and the alleged copyright violator. This is why counter-DMCA claims exist.

This is also why DMCA claims are filed under penalty of *perjury*. If someone knowingly is not the copyright holder and files a DMCA claim against you, you can sue them and easily win.

With regards to DMCA abuse, the only real thing YouTube can do is begin to apply penalties to members with accounts that appear to be knowingly abusing the system.

This might be difficult, because of the Safe Harbor provisions of the DMCA, and other things. They probably wouldn't be willing to take that potential legal risk.

Ultimately what needs to be fixed is the DMCA law, which is what makes abuse possible. DMCA abuse is not a YouTube only problem.

it's not the flagging or the DMCA's that bother me, it's how YouTube reacts to them. Instead of reviewing the validity of a flagged video, they just automatically remove it, and i'm not aware of any way to get it back.

also, the DMCAs. first of all, YouTube allows a DMCA to be filed and passed against any video. secondly, and this is the completely unethical if not ILLEGAL part, you are automatically assumed to be guilty of copyright infringement. so much for "innocent until proven guilty."

A video could be "suspended pending verification of DMCA report." If the docs come up false, the video is restored. Not a big deal. If YouTube didn't want to verify this stuff, the accused could. Problem solved, either way.

This is absolutely important to anyone who uses and enjoys YouTube. This site is one of the last vestages of free speech, free use, (generally) commercial free, user-generated content around. I stopped watching TV a couple years ago and stuck with YT, because of the freedom give to users.

The big problem is... the DMCA. It circumvents freedom of speech and makes it mandatory, without proof, for YouTube to take down videos regardless of the veracity of the DMCA claim.

Unless this terrible law is revoked (or altered to give false claiming serious legal penalties), or YouTube servers and Google leave the USA, false DMCAs and subsequent video removals will be inevitable.

Very interesting but I know from experience as a long time member in a large and popular gamers forum that moderation is a very difficult issue.

With Google/Youtube being as big as it is, their problems in this regard are in fact not only social and education based but also serious technical hurdles. I'm not excusing them but I have to wonder about the people who you spoke with that claim there are resolvable issues. I know Youtube already struggles to keep up.
