  • I do not want terrorist in a court house in my state. The right to a jury is a right for americans not every tom dick and terrorist out there. we here in the united states (most of us with a brain that is) want our rights to be for us . I would not lay down my life for a non american to get rights so that he can suicide bomb my children as they shop at a mall.   • @The1bassfreak The point of due process is to be absolutely sure that someone who has been accused of this or that is in fact guilty of what they have been accused of. If you cut that right off to anyone, even a terrorist then the Justice System is no longer a system of justice. The question raised at 4:24 pretty much explains why. Besides any impartial jury would almost certainly find these people guilty.

  • @javamanV3 Liberals can be me sometimes. I'm a liberal most of the time. Just not when it comes to gun rights. I still call myself a "liberal" a lot of times.

    But a LOT of liberals, not all, seem to have the idea that "as long as its not as bad as slavery, its okay to do it to white people". Actually a very large number of them and it can get pretty violent.

    A lot of conservatives think its okay to kill Iraqi babies because of 9/11, even though babies didn't knock down the towers

  • The constitutional rights of the accused are offered only to citizens and legal residents of the country. Also, the prisoners at gitmo are prisoners of war and any trial against them should be a military trial. Ignoring the fact that these people are prisoners of war and hiding behind a constitutional clause which has no relevence to prisoners of war does not make you right.

  • @mynameismatt2010 Actually you are incorrect the constitution gives rights to all "people" not just citizens of the USA. Also the prisoners in Gitmo are NOT prisoners of war as there was no declaration of war made by the United States, also had the United States declared war legitimately the prisoners in Gitmo would be covered under the Geneva convention and would be attending court in the Hague not in a military trial presided over by the military.

  • @emerice Constitutional perview applies only to citizens and legal residents, regardless of the wording.

    There was an executive order to use military force, so while they may not be prisoners of war they are military prisoners. Which actually means they wouldn't fall under the category covered by the Geneva convention.

    Even if they did fall under the Geneva convention, it is unconstitutional and America has no business following it.

  • I'm a soldier, so I believe that anyone considered a POW, i.e. detainees in Gitmo, show be tried by a military tribunal, and as such have lawyers,= and a jury. Just because they don't wear uniforms doesn't mean they aren't soldiers. If you fight for a cause and have weapons, you're a soldier.

  • I thought I was the only one asking that question. Without a criminal Trial, how do we know if these suspects are guilty? Apparently, in the "war on terror" which is neither a war nor on terror, just being accused of terrorism is enough. What made 9/11 an act of war? It was not sponsored by any state, nor was there a declaration made my anyone, not even Bin Laden. Terrorism is a crime. Even the nazis got trials. Those were not straight criminal trials, I will grant you, but they were tried.

There is a 3-hour block of conservative commentary every weekday morning, and the other opinion shows regularly criticize the Democratic establishment for a number of things, including its fundamental weakness and towing of the Wall Street/corporate line.

MSNBC has commentary and news segments with both liberals and conservatives like Fox or CNN, but the arguments presented are not one-sided like they are on Fox. MSNBC is often at odds with the Democratic party, so to say otherwise is just false equivalency. You appear to be buying into the lie told by the conservative corporate media. It's just not true.

Either way, the ethical question remains: what's the difference between a US citizen and non-US citizen. In this case, a US citizen was also a member of Al Qaeda. So what's the difference between an Al Qaeda member who is and isn't a US citizen?

  • Conservatives make up their own laws as they see fit and they think Fox News is an excellent platform from which to make their twisted views legitament. Fox New is sooo biased for conservatives that people can see right through it. They are to conservativism as what Fred Phelps is to Christianity. Many open-minded conservatives are starting to distance themselves from Fox News because of this. Easy to see why. We should all shutter at the thought of an all liberal or all conservative govt.

I'm a liberal but I share with conservatives my ideas on many issues. Many of my conservative friends are open minded to them as I am to their ideas.   • It should be our goal to extend the rights that all Americans enjoy to every single solitary person in the world. There are not two standards of justice in the world only one. If Fox News had its way we all would be tried before secret tribunals and masked judges in the middle of night.

    Because trying terror suspects undoubtedly will involve violating rules of evidence I propose a more lenient standard of punishment for those convicted under such a system. Go ballistic see if I care.

  • @brandon9271 - a no brainer for you. Again, its not that simple...the confusion about Miranda Rights is in the implementation. These rights are considered to be human rights. Basic in their nature, and therefore they encompass an ideal we believe should be fundemental in nature to all men (and women).

  • Look I agree that everyone should have a right to a fair trial.. but this could be done in a military tribunal. If you do it in civilian court you compromise national security. Maybe we have "insiders" posing as terrorist.. do we blow their cover so they can testify in court? Do we reveal how we intercept their communications or all the inner working of our anti-terrorism efforts to present evidence? After all this is an on going effort. Revealing info in court could give the enemy a heads up

  • @brandon9271 - the difference is that the Mayor's boys answer to the Miranda Statutes because we're cititzens, but the point is that we extend those to anyone because of our moral predilictions as they apply to mankind. (if we have any left) I have lived in other countries, and believe me, our freedoms are not so all encompassing, and people there often mock our arrogance re: our rights, and our superiori freedoms.

  • @pjamesbda Informing people of their rights is the right thing to do. We have allowed the terrorists to use fear to cause us to change what we are doing. This means that terrorism has won a victory against us. If we are not willing to stand up for what we claim to believe in when it matters, we have gone from "give me liberty or give me death" to "oh no I'm not willing to take even a small risk".

  • The big question to ask is WHY? And if the answer is what I think it is, the hate mongers are already deeply rooted within our system and outside it. The bombing of the NY financial sector was no mistake. It was planned and well executed, and the shock built a concensus amoung US citizens that we must answer this force with shock and awe. The shock was watching our entire economy crash, and the awe is realizing it was the second part of the first attack.

  • @pjamesbda It isn't just a matter of "capitalize". Remember that Bush-II closed the Prince Sultan Airbase. This was not an action, I believe he wanted to do. It was done to appease the very sort who attacked us. This was not long after 9-11, so it really showed terrorism working.

If they would just rename themselves Conservative News, at least people would know what they're getting themselves into when they turn to that channel. But people who get their "facts" from media outlets are misguided and misinformed. As a result, you'll start seeing someone holding up a sign that reads: "Keep your government hands off my Medicare!"

    KSM is not an American citizen. Constitutional rights are for American citizens. He is entitled to a trial, but it does not have to be of the type that a citizen is guaranteed. A military trial is fair. It's more than the Al Qaeda loons ever gave Nick Berg.

  • ahh but do you know the sixth amendment? thats the real question, yes supreme court has extended it to anyone in the 50 states+provinces, but we have something called the geneva convention that we use, as well as the 4 court system in the US

  • @Aids5211: It is true that he has his own opinion on these things and I think he might have admitted it himself once or twice but he is also interested in his viewers' opinion and, to be honest, I don't think he ever said he wasn't biased and it's one thing for a youtuber to be biased but it's another thing for a news station to be biased. You'd never see this kind of bias on something like BBC News.

  • How can some people think they have no right to a jury trial? How do you even know for sure that they're guilty? I mean really, what right do you have to pass judgment without knowing all of the facts?

  • I would have thought that where the constitution refers to people it means all people, not just United States people. If the constitution can support charging, trying and sentencing a person it should be done as laid out in the constitution.

    You can't pay lip service to a set of rules when it is expedient. That way anarchy lies.

    Now if it was up to me I'd have had them taken out and shot years ago. Thankfully I've never aspired to be in a position of authority.

  • Listen people I would much rather violate the civil rights of a few terrorist anyday then end up with a severe attack. Just think people if we were to have an attack where 6 or 7 major cities got hit  with chemical weapons. An attack at that level would nearly destory the whole country. I tend to be liberal/libertarian in civil rights matters. I am extremely conservative in matters of economy, trade and defending the Constitution of the US!

    Secondly, the liberals I know are mostly good patriotic folks who keep us in balance. If you enjoy clean food and water, it is liberals to thank.

  • Maybe I wasn't clear, I don't think he should be tried in civilian courts, for those are reserved for people who are citizens, green card holders, those vacationing here, and those trying to become citizens. That's why I think it says people. I mean for trying someone(to my knowledge)has never even been to America in a civilian is laughable.

  • First, your repeated statement that this particular Fox News program is "straight" news is wrong. The format has striaght news then goes into debating the subjects. Second, I do not believe that the rights and privligages should be extended to these non US citizens. A military trial will give them far more justice than they would have gotten in their own countries!!

  • Foreign combatants have never been afforded US constitutional rights. Laws of armed conflict and the Geneva Convention take precedence in these cases. And, military tribunals have always presided over these types of trials, not US civilian courts.

  • "foreign combatants" have been historically been members of armies from sovereign nations that can surrender to us. This is not the case today. Some of these detainees are citizens of our allies and some are minors.

  • This is true. It is a new kind of war, though, with a variety of enemy demographics. I believe the same rules apply, however. In the military, we take an Oath of Enlistment or Commission, and we swear to uphold and defend the US constitution against ALL enemies, foreign AND domestic. I think it boils down to... a war has been declared, and the enemy IS the enemy. I'm sure nobody chooses their side lightly...it's an ugly world we live in.

  • Thank you for informed civil debate on this. It is unfortunately rare. My first concern is that all prisoners get some kind of legal trial. To hold a prisoner who is not part of a soveriegn nation is not OK. (If not a official POW, then they get a criminal civilian trial.) For Non-POWS who are formally trained soldiers; military tribunals would be appropriate. For non-soldiers, criminal courts might be appropriate. And where is the right court for those who were children when they were detained?
