  • The Judicial branch is so messed up. The average supreme court judge stays in power for 27 years. While I don't especially like Newt Gingrich I agree that something MUST be done. Perhaps a term limit?

  • The Supreme Court threatens our liberties? The sitting President and Newt advocate the elimination of the Fourth Amendment. Newt relabels tyranny in populist terms, and the Neocons develop erections.

    The Federal Courts' failure to hold the executive and the legislature to its duties only presents a minor problem. The real problems are an out-of-control executive and a Congress that shirks its responsibilities so that the individual members can get elected without making the hard decisions.

  • @DollreeMappEsq There are actually two problems with the courts. The first is that the other two branches have only been allowed to go amok because the courts have allowed them to. However, the second is that, by ruling on matters that the Constitution is silent on, the courts have been the *single greatest source of political division in the past 50 years*. If issues like abortion and school prayer were left to the legislatures, the "culture war" would have ended in the 70s.

  • @sickoftalking Interestingly, the Supreme Court ran amok after FDR's court-packing plan (remarkably similar to Gingrich's threats).

    I do agree with you that the Supreme Court has failed in its self-appointed responsibility of judicial review. But the Court only has two primary responsibilities: it can only say "no" to executive and legislative grasps for power or it can determine the exact intent of Congressional legislation. IMO, the Court is least scary of the three branches.

  • @DollreeMappEsq The larger picture is that there isn't a respect for the rule of law anywhere, and the court plays a role in that. I don't agree with Gingrich on his threats to abolish courts, I think it would be incredibly divisive, especially since IMO conservatives have lost credibility attacking judicial activism when they supported Citizens United. I don't have a problem with impeaching judges, though, given that conviction requires a 2/3 vote -- much larger than the vote to confirm them.

  • @sickoftalking Impeachment requires the commission of a high crime or misdemeanor. Personally, I am fine with lifetime tenure because I see no better way to deal with judicial activism. Not that it prevents such activism.

    I like Citizens United because it expands free speech. I take issue with the federal government being for sale and the use of campaign contributions to purchase favors. Remove the federal gov's unenumerated powers and the activism, cronyism and favors will end.

  • @DollreeMappEsq Regardless of the merits of it as policy, I think Citizens United was in terms of law, an activist decision. I also don't believe that limiting the governments powers to the Constitution solves the problem. Remember, originally the government's powers were limited. Slowly, over decades, money entered the process, politicians got bought, and the Constitution was abrogated. I think a libertarian stance on this issue just creates "creeping corruption" in the long term.

  • @DollreeMappEsq Second, I think violating the letter of the Constitution would be considered a high crime, and I don't think the Congress is unfit to judge that. The Congress, after all, can determine when the President violates the Constitution, so I don't see why they couldn't determine when a judge violates the Constitution. That's what Gingrich means when he says there's no such thing as "judicial supremacy".

Judges have in no way caused the problems that are being faced in the world today. It's the Government which has done it all, now you CONTINUE to support them?   • Gingrich is a communist. That's why he hates the President of the United States so much. But on another note...to move into the future you have to break tradition and values. One day our books will be on iPads so we won't have to waste paper, etc. Values need to keep up with the changing times. If you look at history, only the racists and sexists have kept the values from the old America. Conservatives tend to be the last ones to get on board and move into the future because they're stuck.

  • As a college student- this is the first time I've ever paid attention to politics. In doing so I've tried to pick a candidate who I think can lead and move the country toward the country I want to find myself in. For months nobody has impressed me in any way. Finally I think I've found my guy, Newt! I may be to young to remember his personal shortcomings, but times are too tough, and the stakes are too high for my generation, to worry about such a trivial matter when the alternative is Obama. N

But he's too smart for his own good and can't break his habit of "reaching out to the our esteemed colleagues on the other side of the aisle". This is no time to pretend people like Obama, Pelosi, Reid, etc are patriots with merely different views. And even if I took a pickaxe to my eyeballs, I'll never get that vision of Gingrich and Pelosi on that couch in front of the Capitol building touting the "fight" on global warming. UGH!

  • wow, It seems like you are crossing the same line, why give you the same power you are complaining the judicial branch is mis-using. if you are going to restore the constitution you will have to get rid of all congressional law. there is no provision for the congress making laws in the constitution. you may only have military, civil and common law so the judiciary branch will not cross the congress because congress can not make laws.
