  • Another example: Marine parks were made (especially in Florida) No fishing of any kind is allowed in the parks. This was originally controversial due to the ease of fish migrations and pelagic species. However surprisingly the fishing outside the parks has improved many many many times more, including many pelagic species that only travel through and dont stay. Some species like the goliath grouper have recovered twice as fast as expected.

  • I will give an example. American alligator was highly endangered and facing extinction. All hunting was banned. Several parks were set up where they could NEVER be hunted as well. Later as populations increased (mostly in these parks) they migrated into surrounding areas. Very strict hunting controlls were then allowed. (but not in parks). Now there is a wise and sustainable hunt every year and the American Alligator is no longer endangered! It was removed from the list in 1987.

  • Here is where you are wrong. It is legal for the Sea Shepard to try and interfere with Whaling in the conservation zone. The UN resolution gives them that right and even duty. However it is illegal for them to board a Japanese ship to do that. They also use other methods that are illegal to a lessor extent. In Canadian or Japanese waters or outside of the conservation sanctuary, they would not even be allowed to interfere at all.

It either gives them the right to interfere both inside and out of the conservation zone (if Watson is to be believed), or neither (if following precedent). (I say neither.)

    In international waters..in a conservation zone...with no national laws to superceed....there is a very good chance Watson could win.

  • @spille1234 In the end this is not about legality for either side. If the whalers could whale legally they would not need nor have the research signs, and if the Sea Shepherds could just sink the whaling ships then they would. But international law does play a part in that neither side wants to be in direct conflict with the UN (the single most powerful organization in the history of the world) and as a result tries to be relatively well behaved (in the eyes of the world at least).

    Japan formally objected to SOWS and therefore doesn't follow SOWS rules.

    The Permits Japan issues for itself are subject to review by IWC rules. During these reviews Japan was cited many times for breaking SOWS and urged to stop.

    CITES lists Minke's as Appendix I (threatened)

    There is some research, but that issue is far from resolved.

    SS authority is by UN resolution and legally binding

  • @rosepetal108 Almost right. Japan doesn't *have to* abide by SOWS rules *wrt minke* because they filed an objection wrt minke.

    Who cares about IWC wagging their finger at Japan? IWC's creation of the SOWS was illegal and the IWC is toothless anyway.

    CITES lists minke as Appendix I for political reasons - to try to give the IWC some teeth. This is why I trust IUCN more than CITES - because IUCN is less corrupted by politics.

There is a difference. Sea Shepards are well aware of the difference which is most likely the reason they have chosen this issue.

Flagged ships in international waters are treated as small pieces of the nation which they're flagged under, so just exchange Canadian law for Japanese law here. What Sea Shepherd's taking advantage of is the difficulty Japan has in arresting their crew. See Pete Bethune's case for proof of both of these points.

    I think it is better that we discuss how to defeat the Sea Shepards and allow Japan to whale. The issue is how to allow Japan to whale and still follow conservation methods.

  • @rosepetal108 The solution is dead simple, really: Get the IWC to admit that Japan's right and change or lift the moratorium, at least as far as it applies to minke. In the meantime, the non-solution right now is at least workable for the Japanese. If the anti-whaling faction in the IWC gets any more belligerent or ridiculous, Japan can just plain leave, and I would cheer for them.

    In any case, things may get interesting again this year, with JCG officers on the whaling ships again.

  • @NRen2k5 Japan will continue ignoring wisdom? It only makes Sea Shepards stronger. You should take some wisdom, if you are forced to fight you have already lost. The best solution is to take your quota of southern minkes when they migrate outside the Sanctuary. Watson gets no TV show, Japan gets their whales, Since Japan has agreed to conservation zone the arguements in the IWC opposition are defeated. It is a much better strategy.

  • @rosepetal108 Watson would still attack them outside the sanctuary. It eliminates the SOWS issues but leaves the issues of hunting minke and being attacked in international waters. In other words, Watson will still attack the whalers, only his justification for doing so will be slightly weakened.

  • @NRen2k5 Much more than slightly weaked. He uses UN resolution as justification for his breaking international navigation laws. However he can only do this as an environmental group acting on behalf of IWC conservation measures which Japan is breaking. Once Japan complies with the sanctuary, then the "research" is completely legal and the permit review is also compliant. Then Watson can be arrested anywhere in the world. He can no longer argue he is enforcing IWC resolutions.

  • @rosepetal108 Additionally there is another benefit. Japan is no longer seen as an outlaw nation with respect to whaling. This strengthens their diplomatic position in the attempt to remove the ban on species that are no longer endangered.

  • @NRen2k5 You underestimate how many people don't like Radical Vegans. If you take away their basic ammunition their battle becomes untenable. For one, They have no footage for their show minimun one season. There goes a huge ammount of funding. He can lie all he wants..but with no show he wont be heard. Less funding means less ships harrasing and looking for the Japanese fleet. Migration routes are big, doubtful he could even find the fleet.

    - Sea Shepherd can't be said to be acting on the IWC's behalf, even now - the IWC actually condemns their dangerous antics.

    - Japan isn't breaking any conservation measures, they've very narrowly sneaked around them. Their research and permits and activities are perfectly legal; the IWC just grumbles because they're not within the spirit of the SOWS.

  • @NRen2k5 Actually like I said from the beginning when we started all this. Japans position for legality of whaling the Minkes inside the conservation zone is disputed at best. A case can be made for both sides.

    Both Sea Shepards and Japanese whalers have been condemed in this little "war" they have. It will only get worse. The best way for Japan to win this war is to not fight it.

I think the best way for Japan to win is to keep doing what they're doing right now: Keeping a record of Sea Shepherd's crimes, keep collecting more research as they whale, and keep fighting the antis in the IWC. The Japanese whalers aren't exactly being bankrupted by Sea Shepherd's activity, and as time goes on, the chances only rise of the ICR proving whaling sustainable, the IWC caving to the Japanese's demands, or Sea Shepherd shooting themselves in the head.

  • @NRen2k5 One problem with that strategy. Japan is still objecting to conservation measures. Be sure 100% no one will remove the moratorium as long as Japan refuses to accept the sanctuary.   • @NRen2k5 See this is the fundamental difference. Japan really doesn't understand the rest of the worlds conservation methods. Therefore people who would allow whaling but also create whaling free zones is a foreign concept to the Japanese.

    For many other countries this is only common sense. It has been done sucessfully over and over to rescue many species, remove them from endangered list and then allow hunting.

Watson was on trial in Canada for attacking several fishing vessels, and his defence was to admit that the WCN is not legally binding but that he sincerely thought at the time of the crime that it was, so he should be acquitted by "colour of right". He wasn't. In fact the judge specifically instructed the jury to keep in mind that the WCN is not law and that they were only supposed to consider whether he seriously believed it was.

    Sea Shepherd has the law on their side? FALSE. They're a private org. with no law enforcement authority.

    Sea Shepherd's tactics are legal? If you admit some aren't, then how can you say they have the law on their side?

  • I applaud these Paul Watson and his efforts. Even though they are very much pushing the law I think it has to be done. In Africa they shoot to kill poachers who illegally kill elephants and other big game and the world applauds these hard line tactics, but for the worlds largest animals we don't care. I hope this eventually pushes governments to take more enforcing action against these murderers.
