  • when you say it's the insurance companies job to pay these guys out, I really can't see why. your mates paid for a product and got what they paid for. they should have read any clauses and read the pds document that was sent to them and then made a decision as to whether what they were buying was right for them.

    while i feel for your mates, there is responsibility on both sides, customers and insurance companies to make sure everyone is getting it right and obviously your mates didn't.

  • @chantal1235 i did some research about Acts Of God .People that live in high risk area's like river banks and well known flood area's etc really cant get flood insurance.An honest insurance company should make that clear that its impossible for them to insure a person for this , because its to high risk & they will call this An Act Of God.If however they have insured you for all types of flood and they try and pull Act Of God crap yeah they should be sued.

    "Act of god" or in insurance terms, “forced majeure”. If you didn’t know this, then you have obviously NEVER read an insurance contract.

    BEFORE you purchase an insurance policy, you must be supplied with a PDS (under the FSRA Act) along with the contract. If you choose NOT to read (dumb!) the contract or ANY contract (not just insurance)that you sign, then you are simply the victim of your own ignorance and arrogance.

    READ EVERYTHING and question before you signup!

  • Insurance companies don't have enough money to pay a large amount of claims at once. Insurance companies take a premium payment and invest it in low risk ventures. In any given account the total premium investment doesn't equate the max claim available. Insurance companies count on receiving more premium payments than claims. When they get a huge glut of claims like this the money doesn't exist to pay all the claims. The only safe way is to manage your own insurance.

And our gasoline price now is $3.09 a gallon in NC (Give or take some cents, prob give more since it was rising.) I believe the more gov't regulation and taxes, the more your gasoline prices. I base this on the fact that when gov't gets involved or runs a company, it costs waay more than the private industry could. But then again, there are many variables

  • To be a viable business Insurance companies have to calculate there risk and price there premiums accordingly. There are companies which offer full flood cover, but it comes for a price. So the people need to know what they need cover for and what they are paying for.

At the end of the day every Insurance companies provide you with there policy documents which clearly states what is and isn't covered , not a fine print, its in bold letters. And to be honest, who reads there Policy documents unless they have to make a claim. You cant say that its the Insurance companies fault.

  • Oh, also, on a sad note - Suncorp, an insurance company that has been paying out to flood victims heroically, is starting to show signs of financial stress as well, obviously they're losing a lot of money by paying out.

    I really hope everyone gives Suncorp a look in the future when they purchase insurance - as they are practically the only insurance company that has been actively paying out for the floods, and they deserve the business.

  • I have actually been doing a lot of research - and anyone who does get a denial due to "Rivers Rising" can likely take legal action against the insurance company they are with. Rivers rising obviously refers to the completely forseeable consequences of global warming, and not the results of a flood.

    If they call up their insurance company, and ask for them to send a letter containing the insurance company's legal definition of "rivers rising", that would be used in court, they will be able to

It would be worth the time - especially if your insurance company uses the words "gradual", "result of global warming" and names a time period and measurement scheme to specify what applies as "rising rivers".

    I really hope people jump on this, because anyone who is denied a claim because of "rivers rising" is likely in a position where they could realistically take legal action.

  • @PUBalanceteam Insurance companies have insurance too to cover disasters like this. They have a threshold and if the amount of claims hit that threshold they claim it again the insurance they have. Those companies base what they charge the insurance companies on the policies they offer to customers and the exclusions that come with it. So insurance companies can't just pay against their own exclusions because they wont be covered to.

    Not only has all the price gouging gone on but we had two huge electricity price hikes in 2009 & 2010. Mortgages went up an average of $150 per/month, trade services price hiked 7% in 2010 even tho tradies wages only went up 3% and trade services have increased since the floods with no increase to wages.

    And just to top this picture off rental accommodation has increased by 9% since the floods. Hell, we haven't even cleaned up yet.

  • I would go loot a price gouging POS and say I was possessed by the devil if I got caught. Lol, no seriously, I would find out who owns the land near the price gouging POS and put signs up after the town has recovered reminding and informing everyone how they acted.

    With the POS insurance companies, I would find as many people as possible thats in the same situation and contact lawyers, goverment officials and media stations(they love it when there's bad news) and rant till something was done.

  • I agree in terms of insurance they should be paid out regardless whether is covered or not the sad thing is they wont be. I wont lie I work for one of these big insurance companies in Australia who will remain nameless and flood is not covered on our policies. It comes down to advertising and wording within a pds, I thankful to say at least we don't say we cover flood and have the river rising exclusions we just call that storm damage. I can go on about this unfortunately those comp wont pay

  • My comment on Insurance companies in my thinking births and deaths are also an act of god so then why do Insurance companies insure people lives to either maturity or death. For one if they change the rules of a policy isn,t that breaking a contract?? This flood was mother nature not an act of god, also the river didn,t flood the towns the water from inland flooded the river. Insurances use wording to change policy so can we

  • Mate you are spot on! i live in ipswich and have mates who have lost everything, to think that they could be in this situation with insurance is unbelievable. They should be strapped to a post in the middle of the Brisbane river at low tide and we'll see how they cope with a rising river mate. maybe they'll change their policies when they realise that they too are totally FUCKED!
