I could see maybe if the officer was speaking to a suspect and you were trying to also speak to the suspect over top of what the officer was saying. But in this situation it appeared that the officers were going through this guys car while he was standing off to the side. No officers were speaking to him, so why can't he talk? I just don't see how that's interference.

    Besides the guy being arrested is excersing his 5th amendment rights -- if he spoke to the copwatcher it could still be used agasit him in court

  • @badpanda84 The suspect definitely started the conversation - it wasn't the other way around. The suspect was definitely not exercising his 5th amendment. And you're right, it could aggravate the situation by talking to a suspect and informing him of his rights; however, the only people that would get aggravated would be the police officers, because they will no longer be able to take advantage of the suspect and it would be caught on film - which police hate to be held accountable.

  • Talking about a warrant, and a search of the trunk.. chances are that guy was under ARREST. You are not allowed to talk to someone in custody and interfere with an investigation. So many of the copwatch guys go beyond observing. IF you're going to copwatch, you should have a training session or something and make sure you guys know the difference between observing, and interfering.

So if someone else gets put into custody then I lose my 1st Amendment rights? I don't understand the logic.   • @1775novten Someone in jail or prison and having visitors is different than someone that was just arrested on the street. When that person is in cuffs and not yet being transported, it's still an ongoing investigation.(example) If you go to court, it's a crime to talk to the defendant, says so on a few signs in the courtroom. Talking to any of them is interfering while the investigation is being conducted if you don't have anything to do with what's going on like a witness, suspect, etc.

For example, if I walked up to a vehicle search and said "Hey man, just tell them were the drugs are and they'll go easy on you", I'm sure the officer would say "yeah, you might want to listen to him". But if I instead said "Hey man, did you give them consent to search?", then all of a sudden it's interfering - it's a joke.

    Actually the main time police enforce that rule ( interfering with police) is when they are trying to calm a situation down -- or break up a fight..

And most of those consents are given because the officers threaten force or monetary penalties. For example, if you refuse consent - the officer will them say "ok, well then we are going to impound your vehicle at your expense and hold it until we get a warrant ." So they deprive of your vehicle and cost you if you don't play along.

  • @badpanda84 Yes, it is possible that in this video that the police lied to the driver and persuaded him into consent. Yes, the police in the field can do whatever they want, and it then later be determined by a court that there wasn't enough reasonable suspicion, but who suffers if the cop was wrong? Not the cop - only the citizen. The cop gets no penalty and the citizen is left with a "sorry, we were wrong - have a good day".

But the investigation has to center around the accused crime. It doesn't give the police carte blanche to do whatever they want once they have you in custody. Again, if they have a warrant to seize your car, it doesn't mean they can go in your house and go through your computer and files.

They are two separate actions. I'll us my same example - If the police have a warrant to seize my car, that doesn't give them authority to also search my house. The warrant specifies what you can search and seize - just like probable cause is specific.

What it means is that the officer needs to be able to say/write what crime specifically he is suspecting of being committed and has to explain exactly what evidence he has to give him that suspicion. Yes, drunk driving is a crime and gives cops enough suspicion to arrest you.

The kid was arrested and his vehicle was towed, just like the officer said would happen. So how did all his sovereign mumbo jumbo help him? I thought you were going to show me a video of someone who was suspected of driving while impaired and was then let go, because a freeman talked his way out of it.

  • @badpanda84 You and I have already come to the agreement that no one can resist arrest. If the LEO says you are under arrest, you can not resist or you will get an additional charge of resisting. I know and understand that and am not disputing that. However, I do believe you can refuse to comply with unlawful orders. Another example - if a cop starts asking me questions, I can say "I don't consent to answering any questions" and the cop can NOT charge me with not complying, but will threaten it.

Yes, I may be arrested and have an additional charge levied against me, but I will not concede to something that is unconstitutional just out of fear of threats of violence. Lets say the driver even had a warrant - are you implying that that automatically gives the officers authority to search the vehicle? I say no. If they serve a warrant for someone at a house, that doesn't give them the right to search the drawers in that house does it?

In the middle of that sort of situation, the police also have the right to decide how far away you have to be. In both of the videos, the officer treated the person with the camera by the book. You really want to help, not just stroke your own egos with false claims? Go to the PCC, and strap on a hidden camera, then go out on their covert observations.

  • @solovocal Well the laws on recording (such as phone taps) rely a lot on the reasonable expectation of privacy standard. Last I checked, there isn't any in public, which is why the cops don't need a warrant or consent to video tape *you* on the street. I've heard some departments claim they should be able to have it both ways, but if any federal courts have agreed with that, I've missed it.

  • Asking the person who was detain a question does not constitute interference with a police investigation Both the videographer and the person detain voluntarily entered into a conversation with each other and didn't do so for an unlawful purpose. Neither of them suggested resisting the cops, escaping, or obstructing the cops.

    Just because that guy was detained/arrested does not mean that he gives up his right to speak to whomever he wishes.

    The cops may not like it, but too bad.

To be quite honest at that point the officer could have been a total dick and put the guy in cuffs for obstruction if he truly wanted to.   • The officer is correct. If you interfere with the "perp" you are interfering with an incident / investigation in progress. They DO have the obligation to isolate the perp for his safety and theirs.

    You MUST remain passive and not active in the investigation. Your right to observe is not a right to interfere.
