  • you enable infringement by allowing any video with copyrighted material to be uploaded. it is this simple. if you were true to protecting copyright you wouldn't allow any online but viewership/ad dollars would TANK . here's how your policy would work in the real world. you & i are pulled over for driving through a red light at the same time. we each have clean driving records. officer let's me go, but gives you a ticket. that's fair. right?

  • If I upload some of my art, which is completely my intellectual property, but use a clip from a song in the background, that owner can claim my entire video to profit from my work and benefit from free advertisement, or even put a strike against my account.

  • IT would be much better if both parties were compensated, because videos, and even covers take a lot of work to make. Even if not, they are giving advertisement to the label and that should be paid for.

  • I personally find it absurd that a record label can claim a video and generate revenue on things which include copyrighted content from others as well, just because a clip of their music appears on it. Traditionally you would at least have to share revenue, Chris brown may have made a million dollars on that wedding video, but the people who produced the hit video didn't see one cent even though they advertised the song.

This new layout will stop people from uploading a viral wedding video on top of this copyWrong issue too.. the content matching system flagged one of my vids and it was audio coming from a car next to us at a red light... the notice said i had a match and there was nothing i needed to do about it.,. next day i got a strike without notice.. and the day after that my cat mysteriously died and her last purrr was STOP COPA!!!!

  • so what im implying is that, such as my friends, subscribers, i have the right to block them from my accounts, i should have the same rights with my video's to block people from using the video on youtube and other social network sites, i beleive that i should be contacted when someone else wants to use my video's and how mty video's can be distrubuted acros the internet. i beleive that we should have the choice.

  • the problem with this system is that i have had a few copyright infringement matches when i made all the content its self from the music to the video and there is no way of contacting youtube directly. plus why don't you delete all the accounts that have copyright infringements because afterall youtube is about you oneself expressing ones self in the best or worst way possible.

  • Any kind of posting of videos online can be helpful to companies by "advertising" it. It's stupid that these videos get taken down so quickly because of copyright.

  • I don't get it. If we upload copyrighted material, then the copyright owner MAY allow it, which is good, OR they reject it and we get a strike against our account. So basically, you have to risk getting a strike just to find out whether or not the copyright owner will allow the video. Is there any way we can check if a copyright owner will allow it before uploading the video, thus circumventing the strike?

I uploaded 1 short NFL clip & I got whacked with a strike. My account was then reduced to 15 minutes max for uploaded videos. I have 1600 videos online. Nearly everyone is my own. Yet youtube placed a strike against me for what was under 60 seconds of the same video uploaded by others. See my other comment below.

  • Copyright owner abuse THE FUCK out of these matching systems. I once did a death metal cover with a musician named Andy Rehfeldt of Armstrong's What a Wonderful World. We put our cover, over some very old TV footage, it went viral, but one day Range Road Records decided to delete all Armstrong content from YT; songs, covers, our video too even though all the content we used was either free our ours.

    So now every time I come across blocked content I torrent it. Greedy bastards, fuck em.

  • @HappyCabbie Nah, at that point the damage had been done and Andy's channel is in enough danger of being shut down for using original vocal tracks in his arrangements as is so we didn't want to bring more attention to it, besides we gave it to people to mirror it a bunch of times, so as long as it's on the internet making people laugh it's okay :)

  • DRM legislation being passed in some countries are quite scary. It seems to be dictated by big corporations who are only interested in limiting content to deny their competition to re-sell or creatively re-develop concepts. Thus limiting the amount of exposure the artists could have gotten with Fair usage DRM. Producing & developing talent does take money & if content is affordable, non restrictive the masses will buy. Corporations should'nt take away freedom of expression!

  • yea well Youtube screwed me over, I saw the Nike "Ennio Morricone" campaign and had the song on a CD I bought years ago and uploaded a video featuring the full length song and it got 3 million views - iTunes then co-oped the song and featured it for download at their store and then I got slapped with a copyright violation and my account deleted. I'm sure iTunes would have started carrying the song because that was a very popular Nike ad, but my 3 million views on my video wasn't chump change

  • @Fulcanelliii actually the civil rights acts of the 50s are what gave corporations all the rights of a person. as soon as the law was enacted to protect minorities, corporations made a case to the supreme court that corporations were persons that needed protecting as well. and they have subsequently called upon that law more than 5x as much as any actual person has sence it was enacted.

  • According to court judgments, anyone can you portions of any copyrighted material for commentary purposes. Youtube was banning all Olympic videos citing the Copyright act, however, if they took the time to dig deeper they would have found that you have the right by law to show clips of copyrighted material.

In reality there is no balance as people are prohibited from uploading on very arbitrary terms catering mainly top down to the whims of a few huge corporations who 'own' the copyrights.

    It sounds too much like polished up propaganda, at which TED too often excels, if not, at least certain speakers they feature on their channel.

  • This gives a rather false picture. It implies that the user can upload copyright matter and YT will sort it out. Thats not the case at all. Their TOS prohibit uploading copyright music - and the wedding video would have been covered by those terms.

    In practice the result of uploading copyright matter is arbitary and changeable, it may be tolerated or the user's account may be deleted, there is no way for the user to know what the consequences of his action will be.

  • By law you are permitted to air copyrighted material in part in a commentary. The problem is that the general public is easily confused as to what "commentary" and "excerpt" means. The Olympics were completely banned on Youtube do to outright threats by the IOC and even though most would argue it is within your rights to air portions of those events, Youtube just didnt want to chance it.

  • The only copyright owners that would take large hits from things like this are probably actually being helped by the exposure. Plus let's be honest, it's not about the creative persons; it's about the managers, distributors, and record companies, etc.

Forcing them to either accept the web and start using it in their benefit without killing user's or even 'illegal' content. They'll probably make more money that way anyhow. The copyright environment needs change. Just let them sue Youtube / Google. If YT get's banned, just let people get angry, and change will be :)
