When cops claim that they are "responding to a comoplain", then you need to challenge them on it. Ask the cop what is the plaintiffs name and what is the complaint? Ask the cop to speak to his supervisor in order for you to verify the supposed "complaint". Cops use this "responding to a complaint" tactic as a guise for them to harass and intimidate you. Don't know why he would need to draw from a sitting position, because if he needs to draw him weapon on the street then he will most likely be standing up. Your aldermen, your mayor, your senators and house representatives, the governor of your state, the president... they ALL have a say in what laws are on the books. So to say that laws are passed without your permission is partially correct. They don't ask your permission to build roads either... but you get to vote for who is in charge.

It's great that you stand up for your rights, but I feel for the police. They have a a whole book of statutes to remember. Generally open carry isn't an issue they deal with on a daily basis. When the poilce aren't sure they have the option to be assholes, or try to treat people with respect. As with any person, police officer or not, we generally afford respect to those who give us respect.

If the call is on a potentially dangerous person the safer approuch can be to focus more on their mental state than announcing your intentions. As for the body language. In Nebraska we are trained to keep a 6 ft reactionary gap and to keep our hands up and ready in case of attack. I keep mine rested on my belt which probably looks arogant.

There is no reason to question anyone that exercises the right to open carry.Criminals will always hide the weapon because they do not want to be noticed. Exercise your 5th amendment rights every single time the police stop you and start questioning you. They might claim that you aren't cooperating with them by not answering their questions but the fact is that as long as you comply by showing them your liscence, registration, and proof of insurance that you are cooperating with the police to the fullest extent that the law requires you to. There is no correct answer to any of their questions. Every question is just a trick question.

I was in the bank the other day her in Chico Ca and the teller asked me for a second ID. , Something with my name on it. I handed over my CCW the teller went and got his manager because he wasn't sure what it was the manager walked over and stated that yes a Carry Concealed Weapon permit is an acceptable form of second ID.
My understanding is that if your'e not driving the officer must have probable suspicion to ask for ID. I don't think he's required to explain to you what his probable suspicion is though. So I feel not giving ID is a losing battle since they can make up probable suspicion any time later. I almost always give ID if asked. However I follow that with, "are you detaining me or am I free to go?" If I'm not free to go and am asked any questions I say, "I'm going to remain silent" and I stop talking.

Gun rights apparently do not influence crime rates, or so people seem to say. So if that's true then the only reason the government would take away gun rights is to enslave us and prevent us from overthrowing them.

The more I learn about Hiibel, the more I believe that this is one of the most pernicious court rulings destroying our 4th and 5th amendment rights. When cops claim that they are "responding to a comoplain", then you need to challenge them on it. Ask the cop what is the plaintiffs name and what is the complaint? Ask the cop to speak to his supervisor in order for you to verify the supposed "complaint". Cops use this "responding to a complaint" tactic as a guise for them to harass and intimidate you. Don't know why he would need to draw from a sitting position, because if he needs to draw him weapon on the street then he will most likely be standing up. Cross drawing takes longer to perform than a normal draw, and these precious lost seconds may result in his death. My theory is that he wears his weapon like this because he thinks it looks cool.

It's great that you stand up for your rights, but I feel for the police. They have a a whole book of statutes to remember. Generally open carry isn't an issue they deal with on a daily basis. When the poilce aren't sure they have the option to be assholes, or try to treat people with respect. As with any person, police officer or not, we generally afford respect to those who give us respect.

If the call is on a potentially dangerous person the safer approuch can be to focus more on their mental state than announcing your intentions. As for the body language. In Nebraska we are trained to keep a 6 ft reactionary gap and to keep our hands up and ready in case of attack. I keep mine rested on my belt which probably looks arogant.

I'm my personal opinion this fella is acting like a little kid. He seems to only do the things he does to draw attention to himself. What is even more troubling he believes he has very few rights, as he states in the video. I welcome him to move to another country, such as China, Korea, Cuba, Iran, Syria, Libya, the Congo, Somalia, Vietnam, or Mexico, and see how many rights he has there. Open carrying would be at the bottom of his wish list. Stop acting like a child, you have it good.

This guy has never had to fight for his basic human rights, and its my opinion that he takes the basic rights he has in this country for granted. He isn't fighting for anything or anyone, he's just causing a nuisance. Sure, he might be within the law, but just because he is within the law doesn't mean he has to be an ass.

I fully agree with you about the immorality of arresting victimless criminals. it makes me incredibly sad that the public tolerates the caging of human beings who's only crime is having a drug problem. as if caging them and forcing them to do for-profit work in public and private prisons is nothing more than the state using public bigotry to enslave an entire class of people. people should be punished for their crimes, not their bad habits.

Exercise your 5th amendment rights every single time the police stop you and start questioning you. They might claim that you aren't cooperating with them by not answering their questions but the fact is that as long as you comply by showing them your liscence, registration, and proof of insurance that you are cooperating with the police to the fullest extent that the law requires you to. There is no correct answer to any of their questions. Every question is just a trick question.

I handed over my CCW the teller went and got his manager because he wasn't sure what it was the manager walked over and stated that yes a Carry Concealed Weapon permit is an acceptable form of second ID.

My understanding is that if your'e not driving the officer must have probable suspicion to ask for ID. I don't think he's required to explain to you what his probable suspicion is though. So I feel not giving ID is a losing battle since they can make up probable suspicion any time later. I almost always give ID if asked. However I follow that with, "are you detaining me or am I free to go?" If I'm not free to go and am asked any questions I say, "I'm going to remain silent" and I stop talking.

Use that "Right".
If you open your mouth you have given away that "Right".
But, a direct statement of identity and intent will usually satisfy LEO.
Your 'Personal Documents' speak for you in a traffic stop. (DL, Reg, Ins paperwork)...you don't have to say a word.
But, again, being polite won't hurt you.
Might save you a ticket.

The more we learn about our "Rights" and the more we actually use them the more LEO will expect us to.
History has proven this to be true time and time again.
