I've always thought they should hide the video pending investigation and restore it if the investigation turned up negative. Furthermore, if the claim proved to be knowingly false, the person who filed it should suffer consequences for it.

The biggest problem I've had when I got a DMCA some time ago (I'm a nobody, I only got one ;) ) was that YouTube refused to give me a copy of the claim itself, effectively hiding the identity of the one making the claim.
If I understand the laws, they are not allowed to do that and must present you with the "evidence" against you, including the claim itself.
Check out Thunderf00t, he had the joy of a false DMCA. But he was merciful towards the fool who filed. You should be able to find out who did it after posting your counterclaim, anyhow... Best of luck in nailing the creep.

It seems unreasonable that YouTube would accept a broad and general non-specific claim of copyright violation. The SPECIFC content should be identified and the original copyright holder, if there is one, should also be fully identified.

However, IANAL, but when you file a DMCA counter notice, you have to disclose your personal information in order for the original filer to be able to take you to court, should they wish to do so. Doesn't the one who file the original DMCA notice to take down your videos also have to provide Youtube with their personal/contact information?

@hoboboxerjoe A number of christian videos have been DCMA recently but it looks like the work of one individual who keeps changing his moniker and establishing new Youtube accounts under different names. I mirrored one of the videos he tried to shut down, not because I agree with what the person said( because I completely fucking do not), but because I am against censorship in all forms, unless i involves illegal activity.

@wendighoul Thank you. I am, personally, a big fan of ZJ's and agree with almost all of the ideas presented here. The difficult part is supporting the free speech of those you disagree with, no matter how vehement their hatred may be. They usually are the ones whose speech you need to support even though you may truly hate what they have to say. Because, if freedom of speech can be denied to one individual just on the basis of content of speech, then it can be denied to all on that same basis.

It seems unreasonable that YouTube would accept a broad and general non-specific claim of copyright violation. The SPECIFC content should be identified and the original copyright holder, if there is one, should also be fully identified.

Adding to my previous post, I don't think YouTube can fairly accept annoymous complaints. If you have a valid legal complaint against another user, you should be willing to indentify yourself, and not just in a superficial way.

The complainer should be forced to give a specific, real, and verifiable name, as well as verified address and phone number to YouTube. If you are making a legal claim against another user, you should legally identify yourself.

It seems that 'Condell Webster Promotions' has gone after more than one person with false claims. I think you should all get together and subpoena YouTube for this person contact information, then collectively sue him (or her).

If nothing else, in a formal copyright complaint, YouTube should verify that the complainer is real, and get legal contact information from them before taking down a video.

Also, the complainer should indicate specifically what the copyright violation is.

DMCA is such bullshit. However, IANAL, but when you file a DMCA counter notice, you have to disclose your personal information in order for the original filer to be able to take you to court, should they wish to do so. Doesn't the one who file the original DMCA notice to take down your videos also have to provide Youtube with their personal/contact information?
If not, at least Mr Webster gets to enjoy the Streisand effect.
