I don't think the plagiarism conviction was justified. It's a standard chord progression (check out Autumn Leaves on Youtube) and a straight-forward melody. Moore takes a very similar melody and turns it into a completely different song.

But fascinating how in their 2007 version, Jud's Gallery play it very much like Moore does.

Back in 1985, I wrote a song .

Somewhere I know I have a tape of my band practicing it. Nobody liked it, said it was too slow and it was gonna put people to sleep because it wasn't fast like Judas Priest freewhweel burning,Accept Fast as a shark, or Iron maiden The trooper,which are among the bands we covered.Well , almost 20 years later TOOL hit big with a song called SOBER. Everybody seems to like that song and becomes of our most claimed. But in in 1986 we had to stop playing because it sounded exactly like super U2 hit "With or Without You", I have tapes, videos but we never registered it, so... I'm still poor like I was in these days. Hahaha...

Inspiriert hat ihn (Gary)das mit ziemlicher Sicherheit, auch wenn er sich dessen damals vielleicht nicht bewusst war.

Jetzt wo ich das "Original" kenne halte ich sogar Quellen-Amnesie für möglich.

Aber Unwissenheit schützt vor Strafe nicht.

Nötig hat es Gary als einer der besten Gitarristen der Welt sicher nicht vorsätzlich abzukupfern.

Wie ich bereits ausfuehrlich erlaeuterte, ist der musikalische Gehalt dieses Stueckes wesentlich geringer, als sich dem (musikalischen) Laien unmittelbar erschliessen mag. WinZip wuerde daraus Kleinholz machen. Aufgrund der grossen Anzahl von Amateurbands ist es aus kombinatorischen Gruenden durchaus wahrscheinlich, dass der ein oder andere Welthit mehrfach erfunden wurde. Eine gute Gelegenheit, Geld zu machen!

genauso wie es feste schemata gibt nach denen sich jazz, blues, metal, rock, klassik-musiker richten... Natürlich bleibt da freiraum für eine persönliche note, sonst gäbe es ja nicht jeden tag neue songs.

aber betrachtet man die anzahl der existierenden bands kann es durchaus sein dass zwei geisesleuchten gleichzeitig auf den selben geilen riff kommen...

So this is the song Gary Moore is supposed to have stolen... please, give me a break. The amount of information (in the information-theoretical sense) of this song is negligible. The chord changes follow the circle of fifths, and the melodical idea is a two-bar riff that is being repeated (adjusted to the underlying chords) throughout the remaining bars. Every musician's brain is able to "compress" this song to a bare minimum, and thus it's very likely that Gary came up with it by chance.
