This is one of the most serious problems in America. Its why i hate Presidential countries. In America everyone is guilty until proven innocent. In many other parts of the world (I live in UK) you are innocent until proven guilty so in a way you are protected against this happening but when your found guilty well god help you. That said the UK system dont always come down that hard.
That is inexcusable. I would suggest you sue but since you aren't a citizen you can't, so I'd recommend lodging a complaint at your US embassy over in Australia.
Thank you for your opinion. Personally, I don't recall ever being asked my opinion on deportation and visa laws, and Canadian policies are equally irrational. Appealing to an alleged majority view that is difficult to measure is also weak reasoning. I'm not really interested in a continued argument on this point; you are approaching things from the point of view that certain legal processes are consistently followed and logical. There is very little evidence for this.

@Timmybear Anyone entering the US as a Visa Waiver entrant agrees, by signing a legally binding document, to waive all due process rights in removal (deportation) proceedings should they violate their status while in the United States. This amounts to agreeing to summary deportation if they break immigration law...and, it works if they are caught. Detention, no bond, no hearings, no appeals, quick removal. Its the way most Americans believe the deportation system should work in all cases.

You could have overcome the refusal by applying for and receiving a visa. If you tried that and failed, that's further evidence that you are not admissible.
Nope it's only evidence that no due process exists whereby I CAN fight such a thing. I have no right of appeal. I haven't been able to do anything. It's been futile. That's how the system is set up. The grounds of my inadmissibility were that I had "No ties to my nation."
Apparently this is more then just citizenship.. It concerns owning a house, steady income for a prolonged period of time etc.. I need to apply for a working or tourist visa personally in Sydney and prove I meet those requirements.
Likely whenever I finally get into a position where I do meet those requirements I imagine my application will be denied as since I have been denied entry to the US before.. regardless of how right or wrong that was.. that fact in itself should be enough to make the decision a foregone conclusion.

He chose to use the Visa Waiver Program instead. Just because he didn't agree with the CBP officer's decision doesn't make that decision an incorrect one.
If he had flown into another port of entry, those officers would have refused him too.

That does not mean everyone who tries to use it is eligible to use it. They have to be admissible first!

@Lavenderrose--The grounds of inadmissibility course is a 12 hour course which could not be summarized in youtube. See section 212(a) of the INA if you're curious. If none of those 30 plus ground of inadmissibility apply, the alien is admissible.
The burden of proof is on the alien to show he's admissible. He never established that he was admissible in every respect.

With a valid entry visa in your passport, and so not entering under the visa waiver program, you then have a right to appeal if they turn you away - problem is, no-one finds these things out until they go thru it first hand for themselves - for anyone who wants to know what this system can be like, just ask a merchant seaman if they've ever joined a ship in the US or traveled thru the US on their way to join a ship... That isn't 100% accurate. If you are not inadmissible under section 212(a)(7) or 212(a)(6)(C), you can request a hearing before an Immigration Judge. Criminal aliens could have such a hearing under section 240 of the Act.
However, those who are inadmissible for documentary reasons are subject to Expedited Removal. There is no appealing a decision to go forward with an Expedited Removal.
The officer at the port of entry has final say on whether a person is inadmissible. It is down to their personal "instinct" or assessment not fact or documented accusation. I was told this by a representative for Homeland Security. It's also on their home page. I was put in a position where I could not appeal simply because they said so. I was told in the end I could not prove means to support myself in the US. This was false. I had provided evidence of this very clearly and it was ignored.
You have my sympathies on this my friend - I have to go thru the wringer with US immigration every few years when applying for entry visas to travel to and thru the US on business - I can't risk the visa waiver system, since by signing that form, you are basically giving up all your rights. I've had this confirmed in the past by an INS official...
Your correct this is true. It's amazing how many people I still run into who don't believe this about the visa waiver. Unfortunately there have also been cases since mine now of whole families being detained and sent back to Australia for much less of a reason then mine while holding full visas so I guess it can't make too much of a difference either way just you have a better chance with a visa..

Many of my friends have gone to places in Europe where it's perfectly fine for the guards to point their guns at you and take you away for interrogation. Upon finding anything threatening, they deport them straight back to the U.S. But you're right, the U.S. is extremely paranoid right now and they will do anything to keep people out.

I was treated rudely at an airport in Phoenix. So what! I didn't mind... I'd stop anyone whom I thought a would-be threat too if I were in charge of Homeland Security! The US has gotten all sorts of threats and attacks... and you want them to be cool about it? If one's innocent, there's nothing to fear... and if they decide not to let me into their country... well... it's THEIR country! You decide who you let into your home... what makes you think they can't? It's their home!
I've suffered insomnia and anxiety issues too. I had Depression and symptoms that looked like Post Traumatic Stress Disorder. I was never diagnosed so coudln't tell Centrelink. I am beginning to wonder about that myself. I know I was arrested once for a misdemeanor which not only did I not do, never happened. The officer was arrogant and arrested me without any proof. Sadly, the courts are on the side of the police no matter what. Supposedly, you are innocent until proven guilty but that rule doesn't apply anymore. And there are those cases where there isn't any way to prove your innocense. It is all done for financial gain!
This is an important story, thanks for telling it. America as a country these days is highly paranoid and I'm sure there are far more stories like yours out there. Of course US officials feel no connection to or desire to help people in your position and homeland security laws now give these people too much power with not enough ability to appeal against their decisions.

Here is what strikes me odd about your story... here in the US people who are so sick that they need to be on disability don't have the kind of money you need to do any international traveling. And if they were capable of doing all that traveling, they surely aren't so sick that they can't work. And if you can't work in your country, why did you apply for a visa to work here?
I didn't apply for a Visa in the US, I merely looked into what would be involved in that process. I also did not have the money to be doing any traveling which is why the majority of it was borrowed money. If you watch my later videos my motivations for the trip may become slightly clearer.
True, you didn't apply for the visa but you did look into obtaining a work permit even though you claim that in your own country you are unable to work. Don't you see how that in itself makes your story less credible?
Not at all since at the time I looked into that I wasn't on government benefits and was actually working. That aside, I'm not really interested in what makes my story "look" more or less credible in as much as I am interested in telling the truth about what happened. The US government will have to answer for what they did and the half-assedness in which the "investigation" was carried out.
Hey, I'm just saying that it was obviously a judgement call on their part and their decision was probably influenced on how you presented yourself. If I were in that position I might make the same call... I can understand how it could happen. You said you were disheveled, had nothing in writing as to where you were staying, held no job, and when questioned couldn't even show your account on youtube where you said you have met all these people. There are 2 sides to every story.
I followed all the rules outlined by the government upon departure. It's their problem they didn't take the effort to get my You Tube site looked at. I don't have a problem so much with what they did as much as that now I have a permanent ban from the US for doing nothing wrong and have no way of seeing my girlfriend. If mistakes are made they should be rectified whatever government makes them.

Maybe it's partly the fact that my whole family has been on this website for the better part of two years and none of us have ever been known to be anything but honest people. There is no reason to lie about any of this stuff and doing so I'd imagine would be a serious offense. I've proven my story to the people I need to and who can actually help. That's all that matters.

In many other parts of the world (I live in UK) you are innocent until proven guilty so in a way you are protected against this happening but when your found guilty well god help you. That said the UK system dont always come down that hard.

Appealing to an alleged majority view that is difficult to measure is also weak reasoning. I'm not really interested in a continued argument on this point; you are approaching things from the point of view that certain legal processes are consistently followed and logical. This amounts to agreeing to summary deportation if they break immigration law...and, it works if they are caught. Detention, no bond, no hearings, no appeals, quick removal. Its the way most Americans believe the deportation system should work in all cases.

If you have been unsuccessful in fighting your refusal of admission for two years, that's strong evidence that the officers did the right thing.
I'd need to know which ground(s) of inadmissibility was applied to you to start any research in the U.S. immigration law books.
You could have overcome the refusal by applying for and receiving a visa. If you tried that and failed, that's further evidence that you are not admissible.

He chose to use the Visa Waiver Program instead. Just because he didn't agree with the CBP officer's decision doesn't make that decision an incorrect one.
If he had flown into another port of entry, those officers would have refused him too.

@Lavenderrose--The grounds of inadmissibility course is a 12 hour course which could not be summarized in youtube. See section 212(a) of the INA if you're curious. If none of those 30 plus ground of inadmissibility apply, the alien is admissible.
The burden of proof is on the alien to show he's admissible. He never established that he was admissible in every respect.

With a valid entry visa in your passport, and so not entering under the visa waiver program, you then have a right to appeal if they turn you away - problem is, no-one finds these things out until they go thru it first hand for themselves - for anyone who wants to know what this system can be like, just ask a merchant seaman if they've ever joined a ship in the US or traveled thru the US on their way to join a ship... That isn't 100% accurate. If you are not inadmissible under section 212(a)(7) or 212(a)(6)(C), you can request a hearing before an Immigration Judge. Criminal aliens could have such a hearing under section 240 of the Act.
However, those who are inadmissible for documentary reasons are subject to Expedited Removal. There is no appealing a decision to go forward with an Expedited Removal.

The officer at the port of entry has final say on whether a person is inadmissible. It is down to their personal "instinct" or assessment not fact or documented accusation. I was told this by a representative for Homeland Security. It's also on their home page. I was put in a position where I could not appeal simply because they said so. I was told in the end I could not prove means to support myself in the US. This was false. I had provided evidence of this very clearly and it was ignored.

I'm really sorry that happened to you :\ But honestly, this happens in most countries. Many of my friends have gone to places in Europe where it's perfectly fine for the guards to point their guns at you and take you away for interrogation. Upon finding anything threatening, they deport them straight back to the U.S. But you're right, the U.S. is extremely paranoid right now and they will do anything to keep people out.

i would appreciate it if you didn't judge my country on the actions of the arrogant upper class leadership and pig-headed fools that are so popular with the media. The majority of us are sane rational individuals such as one would hope to find more of in the world. i can understand being upset by what so many are put through in the name of national security, but that doesn't make the people of the country evil. I was treated rudely at an airport in Phoenix. So what! I didn't mind... I'd stop anyone whom I thought a would-be threat too if I were in charge of Homeland Security! The US has gotten all sorts of threats and attacks... and you want them to be cool about it? If one's innocent, there's nothing to fear... and if they decide not to let me into their country... well... it's THEIR country! You decide who you let into your home... what makes you think they can't? It's their home!

I've suffered insomnia and anxiety issues too. I had Depression and symptoms that looked like Post Traumatic Stress Disorder. I was never diagnosed so coudln't tell Centrelink. I'm a student and still on Centrelink so feel your money situation aswell as wat those American Authorities did! It is disgusting!!!! They shodul let u abck 2 c your friends!

SO you had the money to fly to the USA, with the intention of meeting with a girl you met online, and you were turned away by Homeland Security.

As an American...I concur. You guys should put a call out to all Non-Americans who've been treated this way and put your stories up on one website. Seriously.
Even in this country, we're treated like criminals. Every company I've worked for for the past 5 years has cameras in the offices and workshops to watch what the employees are doing.
The American government doesn't even trust it's own citizens..so this is no surprise.

You, know, this has nothing to do with me personally, but as an American I feel the need to wholeheartedly and sincerely apologize for the way you were treated. It was unfair in every way, but the saddest thing is I'm not surprised. This sort of thing probably happens every day, but you've made it public. More Americans should be aware of your story.
I've never been to Canada, but I can almost guarantee you they won't pull this shit.

What you need to do is set up a paypal account. Then start taking donations to refund you the flight. Then we can claim the donation on our tax forms. It'll be like the US giving you a sweet chunk of change for screwing you over. Seriously though, I apologize for the assholes in my government. I am beginning to wonder about that myself. I know I was arrested once for a misdemeanor which not only did I not do, never happened. The officer was arrogant and arrested me without any proof. Sadly, the courts are on the side of the police no matter what. Supposedly, you are innocent until proven guilty but that rule doesn't apply anymore. And there are those cases where there isn't any way to prove your innocense. It is all done for financial gain!

Of course US officials feel no connection to or desire to help people in your position and homeland security laws now give these people too much power with not enough ability to appeal against their decisions.

Here is what strikes me odd about your story... here in the US people who are so sick that they need to be on disability don't have the kind of money you need to do any international traveling. And if they were capable of doing all that traveling, they surely aren't so sick that they can't work. And if you can't work in your country, why did you apply for a visa to work here?

I didn't apply for a Visa in the US, I merely looked into what would be involved in that process. I also did not have the money to be doing any traveling which is why the majority of it was borrowed money. If you watch my later videos my motivations for the trip may become slightly clearer.

Not at all since at the time I looked into that I wasn't on government benefits and was actually working. That aside, I'm not really interested in what makes my story "look" more or less credible in as much as I am interested in telling the truth about what happened. The US government will have to answer for what they did and the half-assedness in which the "investigation" was carried out.

Hey, I'm just saying that it was obviously a judgement call on their part and their decision was probably influenced on how you presented yourself. If I were in that position I might make the same call... I can understand how it could happen. You said you were disheveled, had nothing in writing as to where you were staying, held no job, and when questioned couldn't even show your account on youtube where you said you have met all these people. There are 2 sides to every story.

I followed all the rules outlined by the government upon departure. It's their problem they didn't take the effort to get my You Tube site looked at. I don't have a problem so much with what they did as much as that now I have a permanent ban from the US for doing nothing wrong and have no way of seeing my girlfriend. If mistakes are made they should be rectified whatever government makes them.

Maybe it's partly the fact that my whole family has been on this website for the better part of two years and none of us have ever been known to be anything but honest people. There is no reason to lie about any of this stuff and doing so I'd imagine would be a serious offense. I've proven my story to the people I need to and who can actually help. That's all that matters.

Yeah they don't let people in from ALLIED countries. It's bad enough the UK is stuck in a "Special relationship" with America, the public got NO SAY or CHOICE in the matter.
