Also, notice the cop that trips and falls to his knees after firing the first shot. The other police believe him to be hit. From the other helmet cam, you see another cop drag him back to the medic as he's trying to reload. Those cops truly believed he had fired upon them.

There were also two rifleholes in the doorframe that did not come from police, and the tip of Guerena's rifle had bullet dings, meaning that it was pointed directly at the SWAT when the bullets hit it. When someone points a gun (especially a quasilegal one) at a cop, the cop doesn't have to wait to see if he gets shot. Aiming a rifle is legally suspicion enough that he would fire given the chance.

@andyxix Check out the latest news. They released a lot more info on Guerena. A prior arrest for drugs and guns. They had also been surveiling him and his 3 friends for a year and a half. Most of the evidence they sought against the gang came from Guerena's friend's house (the missing guns, drugs and cash). And they found that Guerena had lied about his alibi when they questioned him on one of the robberies. They say there is plenty more evidence that will be presented at trial.

They didn't find anything illegal inside his home. The SWAT team didn't announce they were law enforcement. Jose didn't fire his rifle. He most likely assumed criminals were breaking into his home, and armed himself. The fact that he didn't shoot makes me think he didn't realize they were SWAT until he confronted them.
I can honestly say that if I heard someone break into my house, I wouldn't check who they were before arming myself.

@sarge958 that's not what the independent commission found. They ruled it a good shooting. There were also two rifleholes in the doorframe that did not come from police, and the tip of Guerena's rifle had bullet dings, meaning that it was pointed directly at the SWAT when the bullets hit it. When someone points a gun (especially a quasilegal one) at a cop, the cop doesn't have to wait to see if he gets shot. Aiming a rifle is legally suspicion enough that he would fire given the chance.

@andyxix Check out the latest news. They released a lot more info on Guerena. A prior arrest for drugs and guns. They had also been surveiling him and his 3 friends for a year and a half. Most of the evidence they sought against the gang came from Guerena's friend's house (the missing guns, drugs and cash). And they found that Guerena had lied about his alibi when they questioned him on one of the robberies. They say there is plenty more evidence that will be presented at trial.

They go in to pull his wife out, but the kid is hiding in his bedroom, and they believe either the hall to be boobytrapped or possible other gunmen inside. @TheGamingFan100 Lets examine the evidence shall we. 1) There were no items taken from the house as far as I can tell. 2) There were several raids that day and 1 man was arrested that had nothing to do with Jose. 3) As far as I'm aware...none of the so-called evidence has been released.
For arguments sake, lets suppose he was dealing a bit of dope...does a man deserve to die for that? If your head is so far up your ass that you cant see anything wrong with that then...I feel sorry for you.

They didn't find anything illegal inside his home. The SWAT team didn't announce they were law enforcement. Jose didn't fire his rifle. He most likely assumed criminals were breaking into his home, and armed himself. The fact that he didn't shoot makes me think he didn't realize they were SWAT until he confronted them.
I can honestly say that if I heard someone break into my house, I wouldn't check who they were before arming myself.

Regardless what his background is or what activity he might have been taking part off, no one deserves to get killed in that matter.Last time I checked service men and women were been court martial and send to prisons (BRIGS) for opening rapid fire on civilians in IRAQ. A proffesional "SWAT" team would have conducted business in a diffrent matter. SWAT needs to punish and make an example of that wrongful death. After all they fail to proof their case.

any of you ever wonder why the cops wait to invade your home putting your families in danger instead of calmly arresting you at work or at the ATM machine? It's because in your home you are the only witness.
