  • According to Judicial theory that failure to answer the question, or answer in a way unrelated to the question, gives a right to determine the results that can be detrimental to the person being questioned, a bias. Example, a suspect being questioned about a robbery answers "I didn't do it on Tuesday" is not an answer, and answered some unspoken question, we start to find guilt to the detriment of the suspect. The problem is to claim the Fifth Amendment means no testimony, otherwise, answer.

  • I'm hoping they'll let Lindsey Graham ask her the questions about why she opposed having military recruiters at Harvard. I want to see the look on his face when she mentions thinking that the don't ask don't tell policy is wrong, given that Graham is currently a reserve colonel in the Air Force JAG. Maybe she could ask him what his opinion is, or if he knows of any officers that are in a tricky spot because of it?

Furthermore, she was obeying what was then, a federal law stating that any organization that discriminated was banned from any college or university receiving funds.   • Why not haul John Roberts' ass back before the committee and have him go through the process truthfully and see whether or not -- knowing what we now know about the man -- he manages to be confirmed? How about that? Why start getting curious when the nominee is no longer coming from W and Dick Cheney?

    What's funny is that I'll bet that Scalia doesn't have the trust of 1/3 of "the people", let alone a majority. Coburn's statement proves one very revealing thing: he believes that the Supreme Court is an entity to be politicized, which is entirely contrary to the wishes of the Founders. Of course, he learned that from Boosh and Dick-less.

  • @gamoonbat We didn't hear any of the right wing ankle-biters yipping about Roberts' and Alito's unwillingness to answer questions, now did we? I remember reading at the time several commentators noting the dangerous precedent the GOP set. Henceforth, no SCOTUS candidate will really be compelled to answer any questions posed during the confirmation hearing.

  • @kaysandesses - The dangerous precedent was actually set by all of the Democratic senators who voted for those two clowns, including our current president. The Democrats should have stuck it out and demanded questions rather than declining to advise the President on the qualifications of the nominees.

  • @MrGrevy - I thought Elena answered more questions than she needed to. She does come from the East Coast intellectual world. It was her humor that carried her through to confirmation. I was probably thinking of conservative Republicans such as John Roberts when I wrote the above. He was by far the least communicative of all nominees when he sailed through confirmation. I was very proud of Barack Obama and other liberal Senators for voting against him and trying to press for clear answers.

  • Coburn is entirely wrong. The job of a SCOTUS Justice is to rule in accordance with the Constitution while drawing also from legal precedent. It is obvious from his comments that Coburn's entire goal is to completely politicize the Supreme Court. I guess he was asleep when they talked about Separation of Powers during Civics class.
