They can't. They empanelled some senior Judges to decide whether or not imposing death was a proportionate or cruel and unusual punishment in a case where the victim didn't die and they ruled it was.

The other thing is that while I think scum like this bastard deserve to be hung or at the very least never released from prison there are problems.

If you have a mandatory life sentence for an offence then it gives the criminal licence to commit multiple offences.

They would probably sentence him to Imprisonment for Public Protection due to the fact he committed multiple, aggravated offences and have a tariff of about 8-10 years, depending on his criminal history, how he plead, remorse, victim impact statements etc.
