Ofcom is not run by the state. Neither is Ofgem, Ofwat, Ofsted etc. They are independent regulatory bodies. Even if they were it makes more sense to hand 'power' to a democratically elected body than leave it in the hands of organisations like news international whose journalistic standards have been demonstrated to be lacking. Currently the newspapers "self-regulate", which is another way of saying "we're going to pretend that we have someone who checks this stuff and makes sure it's all ok, but they won't really" :P

Also, the fact that it is not legal is also the reason why we need a new wing of state to replace the current system of media regulation, which has obviously not worked, unlike other government-run systems such as Ofcom which have been successful in such matters.

That self-same government has now been voted out, and Hugh Grant is suggesting the new government create a wing to regulate the media on the basis of organisations such as Ofcom, which have been successful.
