Actually it is perfectly legal to film a police officer while he is on duty; the US Supreme Court just last August held that the filming of a Police Officer on duty is a right protected under the 1st Amendment of these here United Skates of Amerika!

Everyone who has a camera with them at all times needs to print out the court of appeals ruling on Glik v. Cunniffe(which declares that the Constitution protects our right to record police in public) and keep a few copies of it folded up in their pocket or purse. If confronted by a police officer for recording, hand them a copy and tell them to go about their business.

As of August 2011, the federal first circuit court of appeals ruled that filming of police is protected under the first admendment. So any law banning police is unconstitutional. Since this has set a legal precendent, all other bans should be ruled illegal if taken to court.

I am of two minds on this. Yes on filming obvious wrongdoing - absolutely. But, maybe not sound. It could hinder the prosecution of the perp if the defense got information from two cops having a discussion. I am not saying this right, but you know what I mean. So it will take work to get a law crafted to allow the citizens to record the cop both audio and video. The second goal is to keep the cops from leaving an audio mike on your car while they go back to the squad car and recording you. Third keep any sex tape of husband, wife private. Fourth some will have word the proposition so that reasonable distance from cops as not to interfere but close enough to see and hear what is going on.

Most of these laws were pushed by FOP, COP and other police unions, fully understanding that if there's no video, there's no crime. And the judges are either so naive or so crooked, will always accept the officers word in a "he said-she said" situation. You need proof. and since the officers are actively eliminating evidence, there should be charges against them for destroying evidence/tampering with evidence.

These laws have been overturned by the US Court of Appeals 1st District on Aug 26 2011. The opinion is that public filming of police in action is an exercise of the 1st Amendment as long as you don't interfere with the investigation.

Actually it is perfectly legal to film a police officer while he is on duty; the US Supreme Court just last August held that the filming of a Police Officer on duty is a right protected under the 1st Amendment of these here United Skates of Amerika!
Those states laws are unconstitutional and you cannot be charged with filming a cop in the performance of his duties; he you are arrested for filming a cop the same court issued a finding that the arrest is a 4th Amendment violation!

When filming police being abusive or not following the law try to stay as far away from all police as you can and still get some clear reliable footage. Audio is very helpful where legal. Use a second source to catch the audio portion. Beware of police trying to delete "your" evidence(If this were you or I, it would be called destruction of evidence, a crime make sure they pay for it). Also be aware that they may try to claim your evidence. Tell them submit a subpoena like the rest of us do.

Everyone who has a camera with them at all times needs to print out the court of appeals ruling on Glik v. Cunniffe(which declares that the Constitution protects our right to record police in public) and keep a few copies of it folded up in their pocket or purse. If confronted by a police officer for recording, hand them a copy and tell them to go about their business.

As of August 2011, the federal first circuit court of appeals ruled that filming of police is protected under the first admendment. So any law banning police is unconstitutional. Since this has set a legal precendent, all other bans should be ruled illegal if taken to court.

I am of two minds on this. Yes on filming obvious wrongdoing - absolutely. But, maybe not sound. It could hinder the prosecution of the perp if the defense got information from two cops having a discussion. I am not saying this right, but you know what I mean. Private conversations by cops at the scene should not be recorded. Or, at the scene of arrest, the perp informs on another perp, it could even put his life in jeopardy.

So it will take work to get a law crafted to allow the citizens to record the cop both audio and video. The second goal is to keep the cops from leaving an audio mike on your car while they go back to the squad car and recording you. Third keep any sex tape of husband, wife private. Fourth some will have word the proposition so that reasonable distance from cops as not to interfere but close enough to see and hear what is going on.

And the judges are either so naive or so crooked, will always accept the officers word in a "he said-she said" situation. You need proof. and since the officers are actively eliminating evidence, there should be charges against them for destroying evidence/tampering with evidence.

With the First Court of Appeals recent ruling on Video taping cops on duty it still would be wise to be ready to be arrested, and not resist. This is where law suits come from. Most cops do not know anything about law., and want you to respond to there every command like a trained animal. Don't resist arrest. That is a charge against you. Keep your camera running and comply. In court.......THEY LOSE!!!

@HistoryTours At the end of August 2011 the First Circuit Court of Appeals announced a ruling that it is NOT ILLEGAL TO VIDEO/AUDIO public servants (ie law enfforcement officers) during the performance of their duties, in public places where privacey cannot be expected. These people are thugs. They will continue their strong arm bullying tactics wherever they can. Accepting arrest is part of the battle along with appealing to a higher court when necessary. They won't give up easily.

These laws have been overturned by the US Court of Appeals 1st District on Aug 26 2011. The opinion is that public filming of police in action is an exercise of the 1st Amendment as long as you don't interfere with the investigation.

It is now illegal in 12 states to film a pig without the pig's consent. One Illinois man is facing 75 YEARS for wiretapping laws. Filming a traffic stop from his own fucking front yard.
