He should have kept his hands out of his pockets and followed instructions. If he wanted to fight the ticket the side of the road is not the place to do it. Idiot is lucky he didn't get shot.
@DiablitoRB Did you actually watch the video?! I thought the same thing at first but after watching the video it is quite bogus. Please provide for me the law, in Utah, that states a cop can pull you over and ticket you for speeding based on what the speed limit is going to be further down the road.
@iamjsmith83 It seems that way but pay attention to why the guy got pulled over. I would expect alot of folks to balk at that bogusness. Let me ask you a question. Should a cop be able to pull you over and ticket you for not stopping at a stop sign before you reached the stop sign?
If the pregnant wife didn't "comply", should she have been tasered too? Neither one of these people posed any threat whatsoever. If a citizen had pulled this they'd be charged with battery. And don't give me this bullshit about how police have SUCH a dangerous job. They CHOSE their line of work. Citizens have to deal with society WITHOUT EVEN BEING ARMED! Anyone defending this "officer's" actions is retarded. He was the only one escalating the situation.
Yeah, believe it or not, that has something to do with why Massey got pulled over by Gardner. For an egotistical sadist, to dominate a pretty woman's husband, and then inflict physical pain on him in front of his family, is the ultimate twisted expression of psychopathic ego. This cop, Gardner, is very ill.
Have you ever been to Utah? Something around 80% of the population are Mormons. Almost all of their women are SUPER HOT! Go visit Salt Lake City sometime and you'll see what I mean.
Tasers are just a human version of the cattle prod and we are the cattle. Go watch the 1971 George Lucas sci-fi movie, "THX 1138" to see how they predicted its use on human beings. And remember Luke Skywalker getting tased by the Emperor? Yes, TASER, Int'l has developed a wireless taser.
alright then so basically cops can just do whatever they want to people to get them to comply, it's how it always ends up the cops become just like the criminals they chase
Our police are OUT OF CONTROL in this country. That idiot cop DIDNT even try talking to the guy. He just went straight for an arrest...THATS BULL SHIT. All he did was refuse to sign the ticket...BIG DEAL its not required. *refused to sign* Its not even a criminal offense!!!! Its civil!
I used to admire police, but the last few years my opinion has changed, and I work in a Prison!
The cop made a mistake as he didn't actually need the signature, but Jared is an idiot for turning his back and walking away from a cop - while moving his hand towards his pocket. People shoot at cops and they need people to respond to their direction or they risk their lives.
If I were the cop I might have done the same thing because the driver put his hand near his pocket as he walked away. You just don't do that to a cop, no matter what.
well, the UTHP says that the cop could have simply written 'refuse to sign ticket' on the citation and sent him on his way...
instead, he escalated this to a life or death situation, and now hamstrings police with the knowledge that the next time they stop someone for a traffic violation, the driver may choose not to cooperate - and may very well be prepared not to cooperate...
5. For Trooper Gardner's traffic stop to be legal he is required to factually predicate his exception to the warrant requirement in that (1) For a charge of violation of a speed provision under this part, the citation or information shall specify the: (a) speed at which the defendant is alleged to have operated a vehicle.(b) speed limit applicable to the section of the highway where the violation is alleged to have occurred.
6. Trooper failed to factually predicate his exception to the warrant requirement to Jared Massey and thus the stop became illegal! The failure of Trooper Gardner to establish to Mr. Massey (a) speed at which Mr. Massey is alleged to have operated his vehicle. (b) speed limit applicable to the section of the highway where the violation is alleged to have occurred.
7. Trooper Gardner in not factually predicate his exception to the warrant requirement of the fourth amendment to the U.S. Constitution constitutes a violation Utah Criminal Code 76-5-304. Unlawful detention. (1) An actor (Trooper Gardner) commits unlawful detention if the actor intentionally or knowingly, without authority of law, (warrent-less, non-specified exception) and against the will of the victim, detains (the Massey family) restrains the victim.
8. Trooper Gardner's violation of Utah Criminal Code 76-5-304. Unlawful detention is a violation of Title 18, U.S.C., Section 242 - Deprivation of Rights Under Color of Law: This statute makes it a crime for any person acting under color of law, statute, ordinance, regulation, or custom to willfully deprive or cause to be deprived from any person those rights, privileges, or immunities secured or protected by the Constitution and laws of the U.S.

The Utah Highway Patrol has now come out with its own internal investigation that says that the officer acted "reasonably".
WHAT! Sad...sad...
