Doesn't matter anyway. Hate crimes legislation punish the implied death threat that is part of every hate crime. A lynching (for example) isn't just a murder, it's a standing threat to the rest of the community.

Um, no sweety, hate crime legislation is, if you'd consider history instead of being a trite 1984 thumper, legislation to enact harsher punishments on those who bring harm to a member of a another group in order instill fear and use that fear to control that group. Hate crime legislation is in essence meant to protect marginalized groups from terrorism from the dominant group.

Thought crimes are not hate crimes because unless that thought was carried out and someone was injured or murdered then the thought is not a crime. END OF STORY. Motives are crucial in solving crimes. If you understood litigation and jurisprudence you would understand that.
