Your bad...start shouting when you are still covered by 13, part I 16 as you luff up further towards the port boat and then of course you could have avoided more easily than the port boat had opportunity to. I would DSQ the port boat too given they hadn't seen you or didn't give a damn, but he probably reckoned he was passing ahead and keeping clear.
