Second, separation of Church and State is NOT IN THE CONSTITUTION! The 1st amendment DOES NOT give the federal government the authority to prohibit expresions of faith in public places. The first amendment states that congress shall make no law either mandating religious activity or restricting free exercise thereof. The issue was intended to be left exclusively to the states.
So I'm confused. Didn't the final version of the NDAA that got passed include a clause that specifically exempted US citizens and legal resident aliens from being detained indefinitely? I read it myself, but maybe there's something else I didn't read. A little help from anyone would be appreciated.

This section doesn't say anything about foreign al-Qaeda terrorists, it says covered persons. What the heck does that mean? If they wanted to exempt US citizens, they would have used ``foreign al-Qaeda terrorists``, or just ``foreign terrorists``.
@22doodster87 And subsection (e) of that same section says "Authorities - Nothing in this section shall be construed to affect existing law or authorities relating to the detention of United States citizens, lawful resident aliens of the United States, or any other persons who are captured or arrested in the United States." I'm not asserting that you're wrong, but this seems like a major cockblock to the idea that citizens could be deemed terrorists under this bill.

All that respective section means is that as regards to standing statutes and laws, if a U.S. citizen breaks them, he is not going to be treated any differently than before. Basically, it's saying if you do something under the existing code, like rob a liquor store, you won't be detained in this way.
@IJUSTLOVETURTLES The NDAA is clear that if "suspected" (and that term is very key, and dangerous, as well) of any of the respective activity listed, the authorities can indefinitely detain you.
There is a provision that states the "requirement" to detain an American citizen is not binding. Note the word, "REQUIREMENT." In other words, it is not that the govt. CANNOT detain you, merely that they are not REQUIRED to, as they are with foreigners.
@IJUSTLOVETURTLES Finally, you have to consider the provision that allows the President to waive many of the stipulations in the first section, so as to bring American citizens under purview.
The NDAA states plainly that all that is necessary for this is for the President to submit a signed 'national security letter' to Congress telling them so.

Even in the most cherry colored interpretation of the NDAA, it is impossible to demonstrate that the Amendment rights are respected, especially 5th and 6th.
PS: The Constitution already has provisions for handling those in conspiracy to attack the U.S. in Art. III, S. 3. The NDAA is unnecessary, and legally incongruent with the Constitution, plain and simple.

It should mention the fact that he executed further BANK BAILOUTS. This is especially glaring at an Occupy event.
It should mention the fact that Obama's top financial contributor in 2008 was Goldman Sachs, and that GS is funding him heavily for 2012 as well.
It should mention the fact that he signed Obamacare legislation, fully cognizant that it was authored by Big Pharma and the Insurance Lobbyists.

Second, separation of Church and State is NOT IN THE CONSTITUTION! The 1st amendment DOES NOT give the federal government the authority to prohibit expresions of faith in public places. The first amendment states that congress shall make no law either mandating religious activity or restricting free exercise thereof. The issue was intended to be left exclusively to the states.

This section doesn't say anything about foreign al-Qaeda terrorists, it says covered persons. What the heck does that mean? If they wanted to exempt US citizens, they would have used ``foreign al-Qaeda terrorists``, or just ``foreign terrorists``.

I'm not asserting that you're wrong, but this seems like a major cockblock to the idea that citizens could be deemed terrorists under this bill.

All that respective section means is that as regards to standing statutes and laws, if a U.S. citizen breaks them, he is not going to be treated any differently than before. Basically, it's saying if you do something under the existing code, like rob a liquor store, you won't be detained in this way.

@IJUSTLOVETURTLES The NDAA is clear that if "suspected" (and that term is very key, and dangerous, as well) of any of the respective activity listed, the authorities can indefinitely detain you.
There is a provision that states the "requirement" to detain an American citizen is not binding. Note the word, "REQUIREMENT." In other words, it is not that the govt. CANNOT detain you, merely that they are not REQUIRED to, as they are with foreigners.
They still have the option.

The NDAA states plainly that all that is necessary for this is for the President to submit a signed 'national security letter' to Congress telling them so.

S. 1021, sub. b2: states that the purview includes "ANY PERSON WHO COMMITTED A BELLIGERENT ACT."

S. 1022, sub. b : States that only the REQUIREMENT to detain is what does not pertain to American citizens.

Even in the most cherry colored interpretation of the NDAA, it is impossible to demonstrate that the Amendment rights are respected, especially 5th and 6th.
PS: The Constitution already has provisions for handling those in conspiracy to attack the U.S. in Art. III, S. 3. The NDAA is unnecessary, and legally incongruent with the Constitution, plain and simple.
