According to Wikipedia the 360 version and PS3 version are said to have rareware (Banjo, Canker, etc.) and Ratchet and Clank chracters as downloadable players, each with their respective system. Didn't mention anything for the Wii or DS, but we can assume if any, it will be Mario.

They ALLOWED Rare the rights to make the DKC games, but when Rare left, they were forced to give up the rights of the DKC characters to the big N due to them owning Donkey Kong.

Therefore, Donkey Kong is first party. Diddy Kong was first party by the time he was in Smash. If he was in Melee, he would have been second party.
