I returned from this wonderful event 1 hour ago. I personally cannot stand being in the city of Los Angeles but in the past 2 weeks of attending liberty minded events and activism I have met the some of the best people not just of LA but people period. There is something changing in people. This event shows this truth in the attendees support and aura. No one asked those who formed 10th A movement and most importantly those of the 10th A movement are not asking for anyone's permission.
This video is just great! I've debated online with quite a few anti states' rights people, and I have to keep thinking about this video. Even college professors resort to the kind of things the zombie does here--they just add fancy words and most people don't catch on to the fact that they aren't even making an argument.
Prof. Woods, while I agree that nullification would be justified in some cases today, you should directly address the Civil War and the nullification (in effect) of the Emancipation Proclamation rather than dancing around it by implying that the term "nullification" should only apply to federal laws and not executive orders.

As for the Emancipation Proclamation, this is not such a relevant example, since in that case the southern states, having seceded, did not think of themselves as nullifying anything. If you're interested in how nullification can work today, it's not helpful to advert to an extremely unusual moment in U.S. history.

The problem with supporting the idea of "State's rights" is that States do not have rights. Collectives do not have rights. Individuals do. Individuals do not have a right to tax, even though the Constitution enumerates taxation as a power of the Congress. If an individual does not have the right to take money from his neighbor by threat of violence, how can he give that right to a politician? The Constitution is null, because it enumerates powers that men do not rightly have over each other.

@ImperatorDominus Federal law does not and was never intended to supersede state laws. Federal powers are specific in the Constitution and the 10th Amendment took care of the rest, including any new issues. Segregation would have ended, and ended much more peacefully than being forced at gun point by the Nat'l Guard.

@ImperatorDominus The Constitution says constitutional laws are the supreme law of the land. It does not say any law the federal government might want to impose is the supreme law.
It's quaint that in 2011 you think of the federal government as a progressive institution. Nevermind the bank bailouts, the wars, the Japanese internment, the gropes, etc.

The Constitution, as insightful as it was in its time, and well-intentioned as it was, is a failure, and can only be such. It institutionalizes immoral violence. I cannot favor nullification on the part of States for this reason. I favor nullification of the United State (not a typo) on the part of individuals. I do not recognize the false authority of any agents of any monopoly State. Men's rights are by nature equal, unless individually and voluntarily surrendered.

If it's not based on sound theory, it's not practical. The Constitution is contrary to human nature. It is illegitimate to try to "work within" a framework, which, of its nature, directly and systematically violates men's rights to liberty and property. It's like trying to elect a new kommandant of a death camp. Insofar as people are killed, it is a death camp. Same thing with a Constitution. Because it violates rights by its essence, it is an illicit means to an end.

Again I don't disagree with you on ideals, but I believe that anything that makes it easier to achieve that ideal is a good thing. And, I would argue that nullification would move us into a place where real classical liberalism could be practiced.

The problem with supporting the idea of "State's rights" is that States do not have rights. Collectives do not have rights. Individuals do. Individuals do not have a right to tax, even though the Constitution enumerates taxation as a power of the Congress. If an individual does not have the right to take money from his neighbor by threat of violence, how can he give that right to a politician? The Constitution is null, because it enumerates powers that men do not rightly have over each other.
