we may not live in a theocracy, but we do live in a democracy. the first amendment does not apply to voters. Pastors, clergy, and religious leaders have every right to convey and express their moral vision onto their community and into the voting process. Prop 8 ,or any other amendment, would not did not and does not undermine the constitution because the government didn't put it into law, the people did, and whether they voted for it on religious grounds is no one's business but their own.

I think you neglected an important fact in your otherwise excellent analysis. Many churches (at least here in the US) DO marry gay couples. United Church of Christ is a very large mainline Christian denomination here in the US which sanctions and performs same sex marriages, even if those marriages are not recognized by the gov. (cont)
My point is that not ALL churches, pastors, etc are universal in their rejection of same sex marriage. Many see equality for gays as an important element of their faith.
IMHO they have every right as free people with freedom of religious belief to arrive at this understanding of god and to have such a belief respected by the government.
