  • Well, he was banging on the hood of the Mercedes, he was a threat to both the driver and the driver's property. Obviously in the driver's mind, his car's hood is worth more than that guy's life.

  • Driver was within his rights. A violent person trapped him in the middle of a crowd that has at times rioted. He happens to be driving a nice car that might associate him with a group the crowd is protesting about. The car moved once as a warning and did not initially hurt the violent protester. After that guy banged harder on the car and continued to trap the driver. Also not that in this video we can not see the violent guys face or hear words he might be saying.

  • The protests in California have been extremely hostile towards anyone not in the protest. Throwing feces and urine at food cart vendors, destroying personal property, blocking traffic (including the freeway in downtown LA), blocking people from getting to work.

    The police should do their job, and anyone with damage to personal property should group together and sue the police for inaction.

  • @lopside0 This is in Oakland, CA at approx. 6:50 pm at 11th St on Broadway on 11-2-11. I witnessed the accident and have video posted as well. It really happened in Oakland. Police are still investigating the incident as of this post.

The driver gave the "victim" first an audible warning (the horn) and then a slight physical warning (the nudge). The "victim" overreacted, became violent & unpredictable. The driver became frightened, and reacted via fight or flight response.  The car was NOT classified as a deadly weapon, and the choice to charge was legally the cop's.

    All ended well, the driver is safe now

Photos taken on the scene right after the incident show no damage to the hood, from slapping or otherwise.

I already pointed out that photos show no damage to the car's hood from the pedestrian slapping it, and that fear of someone denting your hood DOES NOT give you the right to run over them.

    You don't care about what happened, you just want to gloat about someone you feel superior to being harmed.

If claiming fear for his life, he woudl also need to show that he tried to retreat, and the onus would be on him to prove beyond a doubt that the pedestrian was trying to harm him.

    Nope. The crosswalk was about 10-15 feet back from where the hood slapping took place. These were clearly jaywalkers.

  • @AndrewDeLong 1. Look up "11th and Broadway, Oakland CA" on google maps. Goto street view. Line up w/11th, the road the driver was traveling. If they aren't on the crosswalk, they are still crossing at an intersection, which is specifically mentioned in CA law.

    2. You will also see the traffic signal. I don't know what world you live in, but here the top light is RED, the middle light is YELLOW, and the bottom light is GREEN. Even if you can't see the colors, look to see which of those is lit.

It was green, in favor of the driver, which means that the people that were crossing, were not only jaywalking, but they were also knowingly and willingly obstructing traffic.     The pedestrians were crossing at the corner of an intersection, where there was a crosswalk. If they were not directly on the crosswalk, they were crossing at the intersection, which is also protected.

    Jaywalking is a matter of a fine. If they were jaywalking, and were cited for it, they would be issued a fine, not arrested. Unlike the man who tried to kill them with his car.

At the time they first stepped into the road to cross, the driver was more than ten feet away They only stopped because the driver kept honking and yelling at them, and forcing his way forward despite them having right of way. They weren't given a chance to move on again, as he then ran them over.

    Blocking traffic is illegal, but its impossible to make the case that someone was legitimately blocking traffic when they did it for all of FIVE SECONDS.

    And even so, you still don't have a right to run over people blocking traffic.

    Still, let's just call for everybody to take responsibility for their own actions. The pedestrian will get written up for jaywalking, and the driver will get written up for attempted murder

  • I think the driver just got freaked out and panicked. It a shitty thing, for sure, but because he's in a car doesn't necessarily make him feel safe, especially if some punk who feels empowered by all the people around him starts to smash up the hood. Maybe his wife was in the car too... Maybe his kids...

Parents teach you young "look both ways before crossing the road" so why were these idiots on the road in front of a car? and as the guy honks the horn for them to move, the pedestrian starts beating on his car? again, back to kindergarten "don't touch what isn't yours"

    nobody gives a fuck that the pedestrian provoked the driver though, people only see what the driver did wrong. i bet they won't do it again though. =]

He clearly gave the guy plenty of chances to move...but the guy taunted and then proceded to damage his car....the guy was also crossing when the cars had the right of way...that light is GREEN.

  • @Monasukapanough Obviously you either didn't pay attention in driver's ed, or you never took it. The pedestrian has right of way at ALL TIMES. If he tapped him, I wouldn't give two shits about his whales. In fact, if someone was doing that to me, I'd definitely tap him. As for being threatened, I do not see this as incredibly threatening. It would piss me off a bit that he would be so rude, but I definitely would not run him over. This is an incredibly blatant over-reaction.

  • @FML421 Obviously you do not know walking in the path of on coming cars means your getting hit by a car....obviously you don't know when you have the red light it means stop, don't cross, don't walk.....and obviously you don't know that when you see a cross walk, it means walk IN the cross walk..not in the MIDDLE of a INTERSECTION lmao.... and listen to ALL the cars blowing their horns...these people had been blocking the path of cars for quite some time....they was refusing to let cars pass...

    No, it's not. It's a perfectly fine reaction. The so called "pedestrian" was given ample time to remove himself from the temporarily stopped vehicle. Instead, he decided to fight the vehicle, fist to hood. In the eyes of many vehicle owners, that's effectively seen as waving one's right to pedestrian protection. It certainly seems to be the popular sentiment on these forums, and the police effectively agreed, by NOT arresting the driver

  • You've got to be fucking kidding me. When is EVER okay to just run over someone? We have no idea exactly what went down between the driver and pedestrian, but from where I am sitting, the dude in the car nearly ran over two people, and the pedestrian confronted him about it. Possibly inappropriately, but that doesn't justify vehicular manslaughter. Damage to a car does not equal damage to a person.

  • "how dare you put your hands on a car you can't afford?" What the hell is wrong with you? That's like saying "how dare you touch my window, you can't afford it." It's not as if he was damaging the car. Hitting a car is not threatening at all. He definitely shouldn't have been taunting him. It gives a bad name to the protest. But who the hell runs someone over for touching your car? That's like shooting someone because they flicked your ear.

People do crazy things, why make it worse? why even put yourself in a situation like that when it isn't necessary? and i could HEAR him pounding on the dudes car, so i'd be very surprised if there wasn't any damage. Why were they standing in the middle of the road when the driver clearly had a green light, which means pedestrians aren't supposed to walk. maybe they shouldn't be so stupid.
