  • Any of you who think what walmart did is wrong is freakin crazy. Thats not even walmarts policy, its the insurance companies policy, its the same with any other retailer with health care. It CLEARLY states if you sue then you have to pay it back. Why shouldn't you? Walmarts insurance just paid and covered your medical expenses, then you turn around and sue for money? Fuck yea you should pay it back.

  • This is a terrible mistake by some lackey in human resource department of Walmart. Think of all the bad press this is giving them. They may have saved their shareholders $470k, but think how much money they are going to lose by outraged consumers.

  • Have you noticed that Walmart has done nothing to assist its employees in this matter? How difficult would it be to take that "tiny clause" out of its health plan? Having a "legal right" to put nefarious clauses in a contract is nothing short of evil. That "tiny clause" could easily be rewritten to protect Walmart employees from the devastation caused by the "tiny clause". It's just more greed, corruption and villainous behavior on the part of a sadly deficient corporation.

  • Walmart has a duty to its shareholders to recover the money. You're supposed to be made solvent(made whole), so basically in this case she got paid twice. She agreed to it in contract and as such walmart is entitled to the money they for her care. You can't collect twice for the same in jury and that is exactly what this lady has done. Everyone is bashing walmart, but if they don't do it this time then employees will bash them next time when they to collect. Law is law and we need to respect it

  • I do not think that anyone is saying that Walmart is doing anything illegal here...just immoral. Yes, both parties agreed to the insurance policy terms and legally they are binding. I do have to wonder if when her family sued the trucking company and the jury awarded damages, if it was made clear to the jury that the first couple of thousand dollars would not go to her, but back to her insurance company....in this case, Walmart. If not, then that was clearly a mistake.

  • you also forgot to mention.. the husband also has prostate cancer... and also they lost their son 2 years ago, he died in the Iraq war. This is what the family has to go through... very sad.

  • WallyMart spent hundreds of thousand of dollars in legal fees and other expenses to sue her. So they did manage to get their hands on her $470,000 after spending that money. Where have ethics and integrity gone at WalMart and in corporate ameriCa (the big C is for Corporate and Corruption)? I'd bet that their lawyers ended up with almost all of the money. That's more than sad.

  • I am sorry but it has nothing to do ethics. This company is enforcing its legal binning contract to which this lady agreed. Her son dying in iraq, has no bearing on this case.
