Well, the author of this song is Huynh Nhat Khoa (according to other sources: Huynh Nhat Tan). It has been performed by at least 4 singers: Ngo Kien Huy, Andy Quach, Lam Chi Hung, Minh Thuan - which is quite usual for vn songs and completely legitimite as long as the song has not been sold EXCLUSIVELY to one of them (not-exclusive licences for songs are quite common in VN). Who was the first of those singers to have performed that song I don't know though (it is perhaps not easy to find out).
