We had this problem in the UK earlier this year - we were challenging HMRC (UK IRS) in court but of course the judge is paid by our taxes.

This is hogwash honestly. This guy is playing word/semantics games. The 7th amendment plainly provides for jury trials. It does not mention anything about juries being a "court" in and of themselves, especially being a court that is higher than the Supreme court. It does provide that juries be the triers facts. And this is practiced. Factual deteminations are made by juries. Appeallate courts do not retry factual disputes only, there has to be a dispute of law for a case to go to appeal.
