BPCP act protects people like yourself and no where in there claimed that collections need to proof to you the debt exists. It is your responsiblity to protect yourself! Further more, it is against the law (BPCP act) to collect from the wrong person, hence why would two big companies jeopardize themselves for little old you

They are a third party collection agency, NOT A BILLING AGENCY.. you defaulted on a contractual agreement which stated at the time that happened the balance would be called due immediately- therefore the BILLING Agency turned you over to a COLLECTION agency they have no access to your bill or contract in which you defaulted on... sometimes you just have to stop and think about the situation you're in for a minute and stop thinking that everyone's committing illegal activities.

  • Like I said, "You go the skills of being stupid!" They don't care, they can do what they want. A phone call does not work in getting rid of debt off your credit report. Thus, you never talk to them at anytime on the phone, but by writing and replying them with letters.

  • Syndrah is correct, the collection agent must provide you with a copy of the contract. If you send these assholes a cease and desist letter, or a letter limiting communication to writings like he did, then the collection agency can no longer contact you or can no longer contact you over the phone if you limited to writing. . You were very nice to them if it would of been me, I would of sued, and reported them. Do not ever show a collection agent mercy, every time you sue them it cost them.

  • CBV is already calling you..which means your credit is already fucked. regardless of the contract b/s your talking about. They dont need to show u the contract, they dont need to do anything. You signed a contract with telus. Your fucked. only way u can fix it is by paying it in full. It will be removed from your credit report 7 years later.

  • @carling242 your an idiot. first off the collection act forbids them putting it on the credit rating without a claim. in order to substaintiate a claim they must provide consent of the party. its in the courts of justice act. and for that to happen they have to go through several steps to do so. my credit is still clean last time someone put somethign on my credit rating they were fined 10 times the amount for the notice i sent to them. you obviously dont know how to play your cards nor get them

  • They are a third-party interloper. Without evidence of jurisdiction, collection agencies incur debt. If they in fact held jurisdiction, they would simply file in small claims court and outsource collections to the state. They can't legally do and so resort to intimidation, harassment and bluffing. Most of the time, people give in

    If enough people stood up to collection agencies, they would go out of business.

    Better yet, learn to live debt free!

  • @kourier uhm no. collection agencies exist because they originally seen profit as old debts and tied recovering it. since companies didnt have time or money to go after clients.

  • BRAVO! More people need to learn their rights before giving any information to a collection agency. They depend on people's lack of knowledge of their rights. There are several great websites with free information about how to respond to and deal with debt collectors and your legal rights.

  • What Telus and CBV are Doing are against the law. Alot of people that switched to shaw phone service back in 2005,are now out of the blue recieving old phone bills from telus with no explaination as to what the bills are for, and they refuse to tell you anything other than it was a billing error from 2005. They are then selling the bills to CBV (not sending them for collections, but selling them) Then CBV is trying to collect a higher amount than is owed. it already shows on my credit report.

  • It seems pretty obvious that you know its your phone bill, so just pay it. If your disputing the charges, then take it up with Telus or an intermediary such as the BBB. You don't need a certified mail copy of your contract because you know the bill belongs to you. Stop using federal technicalities to avoid financial obligations. If you keep this up, karma will bite you in the ass. Seriously, just be a man and pay up. But if the bill does not belong to you, different story then.

  • you missed the whole point. i never disputed the fact its my bill, im simply asking them to show me the contract. if they cant then they have no right to enter contract between me and telus. not only that but its a breach of contract and they can get hit for large amounts of money this way and its been ruled before on cases like these. collections atre just not used to the fact where people questioning them.

  • no i am not wrong, telus cant touch my credit since they do not posses any tools to do so. even if they did they have to gvie me notice and that is when i can serve them verifycation of debt. collections know better not to touch my credit rating. ill put them on notice that ill be sueing them for 10x the amount. since they accepted it they accept the liabilities.

  • If telus has hired a debt collection agency, then they can pull your bureau, which I'm sure they already have. That alone has already dropped your score. The letter may not have provided you with proof of authority, but if you signed a contract, then you know it exists. If you let the bill go unpaid for 180 days(at least that's the number in canada), I guarantee that goes on your bureau as well. If you're late 2 or 3 months on a cellphone bill and then pay it off it will never show up.

  • telus does not handle going to bureau. if they did then i would ask them to provide a method of LAWFUL payment. even if contracts has collections in it its still a private contract and thus violates it the second it goes to collections. private contracts is ONLY 1 to 1.

  • If your Telus account is in collections, then it's on your bureau NO QUESTION. The method of payment on your letter is lawful I assure you. I'm sorry but you've simply been misinformed. You received a letter from a collection agency, so it's gone to collections. You didn't pay your bill, and now credit has suffered, just go and pull your bureau and you'll see.

  • well actually what i did was much more lawful then what telus or collections did. you see, telus never provided a bill under bills of exchange act. in there it defines what a bill is. which is just a bill of exchange. now if you go to financial administration act and look up money or negotiable instrument it clearly states that a bill of exchange is deemed value. believe me, if they sent a bill i would sign it and return it. but they havent. another thing, collections is 3rd party and CANNOT....

  • interfere with private contracts REGARDLESS if its even defined within it. now that we have that covered. in order in council 16 it eliminates any LAWFUL method of repaying debt since our "money" is considered debt and therefor cannot pay debt with debt. So therefor the definition of money was redefined in order to include more lawful means or alternate means to discharge. you can NEVER pay something off. only discharge or set off. So therefor i highly suggest you go back and do some homework.:)

    There's an R9 on your bureau now boo hoo. A person can only discharge or off set their debt... how is that relevant to you breaching your contract and trying to get away with it? Nothing you even stated was relevant to your problem. Council 16 states money is considered debt, so? So you didn't "discharge" or "off set" your debt... what are you getting at? Are you just waiting for your "bill of exchange"?

  • well i can't argue what i can't see. If you say they never provided a bill then I guess I'll have to take you on your word. None of that changes the fact that you didn't pay your telus bill, it went to collections, and now your credit score has dropped because of it. If you believe that to be unlawful take it up with telus and whatever collections company they contracted out. Either way your credit has been negatively affected. Next time don't expect something for nothing.

  • well if there refusing to remove the account from your credit report thats a FCRA violation and FDCPA violation: FCRA cause they never give you credit to be on your CREDIT report.

    FDCPA tell a third party information thats not accurate. you have to go to federal court to get the money but its very easy the courts will let you explain it. good luck buddy

Youll Call up CBV collection Services depending if there still the company that is reporting to your bureau and youll pay it out.. in full unless you get lucky and they offer you a settlement.. which will close the account.. but doesnt help your credit rating as much as paying it out in full would be..

First. you send a notice of conditional acceptance. this is asking for proof of debt. in canada, there is no real debt because everythign is written off with your signature which is stated in order in council. but hey im fucking stupid. BTW, they closed my account after they recieved my notice of cease and desist. but hey i must be delusion. know the law and itll bail you out countless times. you on the other hand can go work like a slave. Know law.

  • first off, understand that canada is under fractional reserve. all money you have now means nothing. read order in council. there ull learn that canada is bankrupt and therefor gave us remedy to discharge since we have no money. then understand that if there is no contract they cannot contact you. you ca request it but if they fail to provide it then you can send a cease and desist. go and enjoy your sleep sheeple. do your homework.

    I were able to stop collection calls but wat they did was screw up my credit by pulling my bureau every end of the month.....

  • wrong send them a notice with telling them they need 4 pieces of information thus a contract one of them. if they do still try to kill my rating i an in the perfect position to destroy their company, read either cease and disess, notice of understanding or notice of proof of debt, either of those 3 will make it very clear to them.
