Texas is one state that welcomes photography. You can even film a ride on a public bus and not get in trouble. Now some bus drivers feel their privacy rights are being invaded if you are filming on the bus. That's one reason why I always state that if you are going to film a bus ride, to sit near the front behind the bus driver and look out the door. So that way when you hear the engine slow down for a passenger pick up, you can point your camera out the window.

BE ADVISED : All shopping centers are private properties with some that have hired security to observe and report anything on their clients private property, and to enforce all of their clients rules and regulations for that property. you have no case being that you were on private property.

I got cought filming the scenic elevator at the shops at riverside too! The security gaurd was really nice though. He was fascinated why I film elevators and what I do with my videos. I said I put them on YouTube. He said that's especially not allowed because of security reasons. He told me to delete my videos. I stepped into a Simon Mall for no money. Actually, 2 malls (Cordova in Pensacola and Pier Park in Panama City Beach, both in Florida). They both have laid back security for photography, as I made several videos in Cordova and I was snapping some shots at Pier Park, even a guard let me take HIS picture. It is all in how the mall is coordinated, and management status. I believe since both areas are hot tourist destinations for beaches, they let this rule go. Down there, at least.

So my point is, it may be logical to boycott an entire company, but each mall is managed accordingly and some malls have different ways that they enforce their rules. You will also find that some managers are more open and accepting to photography than other ones at different malls. It's just the way certain malls are managed, and maybe it would be best just to steer clear from those that are less accepting than ones that are more accomodating to the policy.

The only mall i have ever had trouble at was Lenox Square mall. Typically before I film an elevator, I simply make sure security is not watching and then there is no trouble :)
@neurodistortion Your kinda right. how strictly the no photo policy is enforced depends on each indivdual mall, regardless of what company owns the property. I spoke to the security director in person at South Shore Plaza in Braintree, ma, and while he kindly explained me the reason for the photography restrictions, he said that they wouldn't mind of you were just photographing your family and friends, and they also accomondate requests from students to photograph the mall for projects.
I have posted a response to neurodistortion, and I explained that a mall being owned by simon malls doesn't always mean very strict enforcement of the no photography policy. How strictly a no photography is enforced, and the way its enforced varies by individual malls, and mall management regardless if the mall is owned/operated by Simon Malls, General Growth Properties, Westfield, CBL, Pyramid Companies, etc.
Also, I know a general manager of a Simon mall and she is adamant of the community she represents and that she's aware that people will photograph for certain purposes. Some businesses prohibit photography of their storefront displays though and the mall has to honor that for legal purposes, but generally it's okay to get photos of a mall's interior as long as you give proper notice. I've also asked her about the elevator filming which she finds interesting, but she doesn't see it as a big deal.
While I respect a mall's privacy, I think capturing the interior of malls is important because malls as we know it are slowly disappearing and it's essential to chronicle and photograph them before they're gone. A lot of malls have fallen by the wayside and pictures are hard to come by with some of these defunct places which is a shame, especially if it was known for its architecture. People see malls as disposable places but they are just as important to the landscape as a city's main street.
Simon Malls are Private Property. Pictures and video are how a lot of criminals case the place so they can go into businesses and steal. As a mall business I am glad the policy is in place, I enforce it in my store. It is also my private company policy. Quit your damn whining and respect the malls right to their privacy!

I worked part time security at a Simon Mall. I have a full time "real job" but needed the extra cash. I noticed that the other guards including the supervisors were idiots that could not put two sentences together that made sense. They paid $10.00 an hour so I figured that this is what Simon does pay peanuts and have peanut brains working for them.

@neurodistortion Your kinda right. how strictly the no photo policy is enforced depends on each indivdual mall, regardless of what company owns the property. I spoke to the security director in person at South Shore Plaza in Braintree, ma, and while he kindly explained me the reason for the photography restrictions, he said that they wouldn't mind of you were just photographing your family and friends, and they also accomondate requests from students to photograph the mall for projects.

I have posted a response to neurodistortion, and I explained that a mall being owned by simon malls doesn't always mean very strict enforcement of the no photography policy. How strictly a no photography is enforced, and the way its enforced varies by individual malls, and mall management regardless if the mall is owned/operated by Simon Malls, General Growth Properties, Westfield, CBL, Pyramid Companies, etc.

Also, I know a general manager of a Simon mall and she is adamant of the community she represents and that she's aware that people will photograph for certain purposes. Some businesses prohibit photography of their storefront displays though and the mall has to honor that for legal purposes, but generally it's okay to get photos of a mall's interior as long as you give proper notice. I've also asked her about the elevator filming which she finds interesting, but she doesn't see it as a big deal.

While I respect a mall's privacy, I think capturing the interior of malls is important because malls as we know it are slowly disappearing and it's essential to chronicle and photograph them before they're gone. A lot of malls have fallen by the wayside and pictures are hard to come by with some of these defunct places which is a shame, especially if it was known for its architecture. People see malls as disposable places but they are just as important to the landscape as a city's main street.

Simon Malls are Private Property. Pictures and video are how a lot of criminals case the place so they can go into businesses and steal. As a mall business I am glad the policy is in place, I enforce it in my store. It is also my private company policy. Quit your damn whining and respect the malls right to their privacy!

Here's a crazy thought... a mall, like any other business is PRIVATE PROPERTY. So, just like your house, what they say goes. If I tell someone they cannot take pictures of my kitchen table then guess what, they can't do it. An introductory class of Constitutional Law would be helpful before railing against a PRIVATE corporation or the people they hire to enforce their rules.

The scrolling text is a bit distracting. Hearing a story second-hand is a second strike against your video. Agreed that Simon malls should be avoided...not because of their policies, though. Can't say I blame the security. They told him twice to quit filming, then found him looking around for the elevator machinery. Nice. Agreed that the whole "homeland security" thing is thrown around way too loosely. I guess a lot of security guards want to feel like they're combating terrorism, LOL.

I worked part time security at a Simon Mall. I have a full time "real job" but needed the extra cash. I noticed that the other guards including the supervisors were idiots that could not put two sentences together that made sense. They paid $10.00 an hour so I figured that this is what Simon does pay peanuts and have peanut brains working for them.
I noticed these guards doing things to people that probably did not know their rights. I was told to do things that I disagreed and refused to do.

Also, to attach to my last post, all malls are big places that house a lot of people at once. What do terrorists like to do? Oh yeah, they like to aim for places with a lot of people to kill like Stadiums and MALLS, so security officers must always be wary of people with cameras, and well trained security officers know what to look for for hidden cameras and other devices. Nobody should take pics of a mall's architecture because it can show weak points in security and places to put a nice bomb.

Dieselducy, do yourself a favor and brush up on your basic law a bit before you bitch. Your "rights", which are really just privileges, were only created to protect you from GOVERNMENT OFFICIALS. Malls are private properties for public use, not government entities, and they reserve the right to create their own code of conduct which you must follow if you choose to be a guest. How would you like someone coming into your house and taking pictures of all your stuff and then leaving?

you need a special permit to solicit political messages in the mall. unless it is officially licensed NFL, NBA, NHL, or MLB, licenced merchandise, you are considered an outsider trying to gain entry into the palace. therefore with that permit you can promote anything that is written on that permit.

Believe it or not, a friend of mine In real life mind you, worked for allied barton and was s a security guard for Simon, and he got completely Agitated and quit because of the Simon mall war against photographers, and he did not want to get involved and i never spend a penny or ever will at one of their malls, no further adue, I support the fight agains Simon Property Group VS Photographers.

I went to Southdale Center in Edina that's a Simon Mall a lady @ JC Penney told me where is my parents but i'm grown up! But it's not a great mall I was disappointed with the whole mall except the Macy's store. But I didn't get yelled at by roudy security guards or anything. But Bergen County is a ghetto!

I want to go back to McCain Mall (Simon Mall of course) and the management why the mall doesn't have an elevator. People with strollers and wheelchairs have to go to JC Penney or Dillard's to get on the elevators. One more the elevator in JC Penney was broke due to the hydraulic oil ran out. I'll find out what the response will be later.

The founders was Melvin, Herbert, and Fred Simon. 4. The locations are in United States, Puerto Rico, Japan, China, South Korea, Mexico, France, Italy, and Poland. 5. They built the headquarters in Indianapolis, Indiana and opened it in 2007. And 6. The first Simon malls that opened is Houston Galleria and South Park Mall.
