They out it back on the shelf and the kid just happened to pick it up.

That is the responsibility of the employee that has taken that item. I've worked at a retailer as well. It is a responsibility to check for such a thing. If the item was checked as new then it must be some work that they did making it look as though it was new. The sticker that was placed on the box should prove whether or not it was opened.
