The Constitution is very specific in stating that the powers of the federal gov't are VERY limited and can not encroach on individual states. this is the way it was intended but not the way it is practiced. this is why today the federal courts are turning over laws which were VOTED IN by the people in AZ and CA, when the federal court really has no such power to do so. that being said, it makes me sick how liberals have no regard for the constitution, unless it benefits them.

Legislators actually had to demonstrate that the laws they passed were allowed by the Constitution. Remember women's Right to Vote? The Supreme Court correctly ruled it was not a Constitutionally protected Right because it was not in the Constitution. It had to be added.
How about the Right to Keep and Bear Arms? The Supreme Court correctly stated that if a short shotgun has combat use, it is Constitutionally protected.

The Alien and Sedition Acts created after the Constitution was a direct violation of these principles. In fact, up until the 1950s the Constitution was treated like a mere document.
Abraham Lincoln enacted policies against slavery despite the Supreme Court's objections.
FDR enacted New Deal policies even after the Supreme Court Packing problem, and did so even though the Court knocked anything down.
Again, a lot of Mr.Klavan's statements make sense... if you don't know the whole story.

Woah this history is horrible, even looking beyond the humor. The Articles of Confederation were made in 1777 by the Continental Congress but the actual Constitution was made after the war ended, by the Federalists and Hamilton who wanted BIG Federal Government. Only half of the Constitutional Convention had actually served on the Continental Congress, and only 8 actually signed the Declaration of Independence. Thankfully remaining Revolutionaries ensured the Bill of Rights. But I liked the vid!

I love arguing on Facebook with people who call themselves Conservatives, and tell of how they love the Constitution, and then tell me they support Prop 8 in CA and the Immigration Bill in AZ and want to eliminate parts of the 14th amendment.

But seriously, there's nothing wrong with the Arizona law. The allegations of unconstitutionality are dead wrong, the "fascist" angle is unfounded, and possible abuse by racist cops is negligible.
The only legit argument against it is that maybe, perhaps it might impede local law enforcement from doing their regular jobs, but that's still stretching it.

I agree with everything Klavan said, although I would do one thing different. If I were trying to bring to the forefront the abuse and the outright disregard of the Constitution that our ancestors wrote, I would show examples from all parties of government, not just Dems. I myself am a Rep., but in todays climate, when trying to spread the truth, it shouldn't come across as biased. It's sad that the state of our country has been so split. Red or Blue, Rep or Dem, we are all American,

so the problems we face now and in the future will be felt by all, not just individual parties. We need to come together to make a change, cause if we don't, the freedoms our ancestors fought for will be slowly whittled away, right under our noses, because we as Americans have become to complacent, just because we feel we can't do anything, even if we tried. Rest assured if we don't try, our children will live in a very different place, and not for the better I assure you.

Is this guy serious? Article 1, Section 8 in the *enumerated* powers of congress is: The Congress shall have power To lay and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defence and *general welfare* of the United States; but all duties, imposts and excises shall be uniform throughout the United States.
If this guy is trying to show that politicians are idiots, he shouldn't have to search to hard, but he's clearly mistaken on the law.

@peacefrog630 - I don't think that socialized medicine can be considered to fit under "general welfare". I would see it more as, for example, building a levee for New Orleans or something. People didn't need socialized medicine 200 years ago, and yet people are physiologically the same as they were then. The differences between then and today that contribute to many sick people in this country are sedentary lifestyles, harmful lifestyles, not enough exercise, and poisoned food, water and air.

This is good an true. What is scary is that there is a lack of respect for the rule of law. When just laws are not respected by those in power violence results. That's why the old people in wigs wrote "to establish justice and ensure domestic tranquility". I fear we are in such a period of lawlessness that violence is not far off.

The Constitution is very specific in stating that the powers of the federal gov't are VERY limited and can not encroach on individual states. this is the way it was intended but not the way it is practiced. this is why today the federal courts are turning over laws which were VOTED IN by the people in AZ and CA, when the federal court really has no such power to do so. that being said, it makes me sick how liberals have no regard for the constitution, unless it benefits them.
