The constitution doesn't spell everything out because the framers knew that they wouldn't be able to predict every possible eventuality. Instead, they created the judiciary for the purpose of interpreting the law. If you think something isn't constitutional, go get a court ruling. According to the constitution, we don't decide what's constitutional based on any direct democratic means. It's the role of the judiciary.

Geithner explained that the authority of the FED originates in congress. The authority of congress is constitutional. Congress delegated their power to the FED. This isn't very complicated. I can't believe that Bachman is actually as simple as she makes herself sound.
Article I, section 8, paragraph 5 gives the power to the Congress which gives it to the FED and the Treasury and is what Geithner said. She is rather thick and proves she hasn't a clue as to what Congress does.
The point she was actually making is that the existence of the Fed in itself is unconstitutional. Congress did not have the right to vest a private banking cartel with the ability to create American monetary policy. The Federal Reserve Act was passed in 1913 with only three congressmen on the floor and later President Wilson seriously regretted his assistance in handing over this all-important power to a private elite.

1) True, but the power the constitution gave the legislative branch was, amongst other things, to specifically ensure the proper functioning of trade and currency... which is by an large what the Fed does and what all central banks do when a country switches to a fiat currency.

This just goes to show that Ms. Bachman is on it! Her questions were superb & to the point. However Geithner & Bern-snacky, were NOT straight forward nor could they answer her question without exposing themselves COMPLETELY & the plan. She was stating that not only were they're radical actions unconstitutional but that both were willing to forfeit the United States & it's dollar for the proposed 1 world currency. That's the plan all along, degrade the dollar so that power is given elsewhere.

It sounds like Bachman could use a 10th grade civics class. Geithner explains that FED powers are delegated from congress. He was delicate enough to forbear. He might have silenced her by simply pointing out that the FED is not addressed specifically in the US constitution. Either Bachman is as ignorant as she acts, or she's up to some wily antics, exploiting her backwater base.

Article I, section 8, paragraph 5 gives the power to the Congress which gives it to the FED and the Treasury and is what Geithner said. She is rather thick and proves she hasn't a clue as to what Congress does.

The point she was actually making is that the existence of the Fed in itself is unconstitutional. Congress did not have the right to vest a private banking cartel with the ability to create American monetary policy. The Federal Reserve Act was passed in 1913 with only three congressmen on the floor and later President Wilson seriously regretted his assistance in handing over this all-important power to a private elite.
The simple fact that a law exists does not mean it is legitimate.

The question is absurd... the constitution cannot and should not explicitly grant every single power or law. The constitution is a foundation upon which all laws in the USA are enacted and their constitionality is essentially granted by the legislative body in conjunction with the judicial.
The Fed isn't in the constitution because the constitution predates it. To have to rewrite it wheneve a law is passed makes no sense. A monolithic constitution would be dangerous.

1) True, but the power the constitution gave the legislative branch was, amongst other things, to specifically ensure the proper functioning of trade and currency... which is by an large what the Fed does and what all central banks do when a country switches to a fiat currency.

It's one thing to talk about encroaching government powers. it's another thing to talk about powers it legally has.

See that is the part I have a problem with, the degree to which government should be reduce. I am with you guys for removing a majority of foreign bases, getting rid of of some government office (DHS, NSA), but I want socialized health care, utility companies, and possibly banks. I want the government to help people, and a pacifist foreign policy. I want the CIA and FBI though and several other agencies. I want a little bit Libertarian and a little bit socialist.

Free market conservatives as opposed to neoconservatives. Free market meaning allowing businesses to declare bankruptcy, receivership etc. Compromising on certain issues will be necessary, but given that you are fiscally conservative we'll have more "major" issues to agree upon than disagree.

Although I have opinions on these matters, they would be somewhat irrelevant for me to take a strong stance on. I'm willing to accept a welfare system so long as the government can afford it and abuse is controlled to a minimum. Immigration is a vague term. I oppose illegal immigration because I oppose any illegal act by a person. Gay marriage is left to the individual and the states. What are your stances on these issues?

The TARP bill authorized the actions she was questioning. Congress's authority to pass such legislation comes from both the Necessary and Proper Clause and the Commerce Clause of Article I of the U.S. Constitution.

Just as it would be in the courts, the burden is on you to explain how the action is unconstitutional. We're all ears.
Hint: blanket assertions such as "we were founded on ideas of capitalism and freedom with responsibility" will get you laughed out of court. Either find something in the Constitution or federal case law to back up your claim, or try your hand at 8th Grade civics once again along with Rep. Bachmann (R-Beauty Pageant).
