  • The tip is mandatory. It is not an optional part of dining out. If you can't afford to tip, then you can't afford to dine out. Do you want me to come to your job and take part of YOUR pay away? To requier a gift In itself is a contradiction. first the tip should never be mandentory! suggest yes and mybe a persent too if the sevice was adiquet. The contract between the patren and the restaurant, custamary is to provide eatable food and  adiquit sevice befor payment is made! if these requierments are met then payment is made. If not payment is to be determined accordingly. call 911 is a joke

  • If a gratuity is mandatory on large parties (which they usually are, and it is usually posted) then that added into the bill becomes part of the bill. If they didn't pay it, then they did not pay the complete bill and therefore ARE guilty of theft. The smart thing for the couple to do would have been to pay the tip and consider it a lesson learned and take their business somewhere else in the future. The Police (even though they may not have like it) did the correct thing.

  • @alandalus1 .. Tips are not always optional. If you have more than a certain number of people in your party it is usually mandatory and is added in. Also, a lot of places add the tip in when you order food to go, as well as when you order food to be delivered. Pizza Hut, Dominoes, Etc.. are real bad about it. Next time you order from them check your receipt real carefully.. it is usually written in as a surcharge, which means you double tip.

  • A tip is a gratuity! to say that it is part of the bill is wrong. The problem really arises because gratuities have become illegally taxed. For police to arrest someone for $16.00 means that the taxpayers have to pay for the time that the police were handling this situation, for court, jail stay and everything else involved with this arrest. The establishment should be billed to recover losses for the taxpayers. The couple should receive a refund for indigestion and to recover court costs, etc.

  • Gratuity is part of the tab if it is listed on the menu. When you order food or drinks you go into an agreement if you don't like it don't eat there.

  • Guess what? If they restaurant says it requires a 18% gratuity, also known as a service charge, then you are REQUIRED to pay it. It's part of the service. Even if you have slow service, that person is still providing you with service, so you have to pay for it. Why should it be free??. Glad the owner taught them a lesson!! Take notice people!!

As a bartender who gets paid $2.13 an hour myself, I think tipping should always be mandatory and should be enforced by the government. since they tax us on tips we dont make because of you a%%h*les!

  • I have always left a 15% tip as a minimum. I have always appreciated waiter/waitress people for being hard working busy people. In most cases more than 15% would be the case. I don't think however that a mandatory gratuity is a smart idea from a business standpoint. The tip should be an expression of appreciation for a job well done, not something the establishment guarentees the server will receive......good service or bad.

    The restaurant's policy was that the gratuity is "mandatory" for parties of 6 or more.

    It's morons like you who accept the terms of an agreement to recieve the benefits and then refuse to follow those terms after you've recieved those benefits.

  • @jamespaulkeegan I actually get $1.26 an hour. I work as a waitress, as a part time job while in college. I barely get by, but guess what: I don't throw a fucking fit when someone doesn't tip me. If they do, that's great. If they don't, oh fucking well. I'm GREATFUL they even eat there, so i'm not out of a damn job. There isn't a damn sign on the door saying they HAVE to tip us.

  • @giathecat You can be arrested for not tipping if they list the 18% as a mandatory gratuity for a party of 8 or more. Whatever the policy is at that restaurant, they went there and thus have to abide by its rules.

  • I always tip, but it varies greatly depending on service. I used to manage a restaurant, and have had to go out back and tell smoking waitresses to get to their tables, that they were needed. So, I know that poor service is often the result of laziness. I also know that sometimes food is slow to come out of the kitchen, so that is not a server's fault. But, when I have an empty glass for 20 minutes, and my idle waitress, and the beverage I am drinking are in plain sight, the tip goes way down.

Like you said it isnt always the servers faulkt, but if they walk by you 3 or 4 times and its obvious you have an empty glass, they can fill it up. I actually had a waitress last month in this city i was passing through raise her voice saying "well why didnt you just get my attention somehow!" When i was smiling and riasing my glass trying to make eye contact. Plus the food sucked so i gave her a 2 dollar tip

  • This is pure bullshit. In my 30 years as a bartender/waiter, I had bad nights when I KNEW I couldn't service my people properly at all. And there were times, when I actually gave back tips because I just didn't want people to have to pay for what they didn't get. Asshole bartender is a pure punk. Thank Gerald Ford for making gratuity a taxable transaction in the first place. Restaurants that put mandatory tips on the bill are just trying to limit the wages they have to pay out of the biz.

  • The "mandatory tip" is only a civil agreement between the establishment and the customer. I would say the arrest was unlawful. It should be dismissed either by the police department or the court and they should do it fast. Hopefully someone with some sense will figure it out.

  • @BunkerGearGal - No Way I am not a douchebag. Servers wages are only 1/2 of minimum wage which means that even the US Government and the IRS intend to take the other half of their taxes out of the tips which you SHOULD be earning.

    When you eat in a full service reataurant you are EXPECTED to tip. If you receive bad service than leave a bad tip to reflect that- this will also let your server know that you were not happy with some aspect of their service and give them a chance to change it.

  • Mandatory Gratuity is a misnomer If it is Mandatory means required, so how can it be a Gratuity (which means voluntary). If it is Mandatory then is is a Sales Tax, and NOT a gratuity! The ignorance and lack of forethought in both the the lawmakers, enforcers and some of these reporters is mind numbing!

    Regarding your description, it's important to keep in mind that police officers are trained to be experts in enforcement, they are not legal experts.

    And it kind of has to be that way... if you had to go to law school to become a cop, why would you choose a cops income over a lawers income?

    I know it's not ideal, but there's no such thing as a perfect system.

  • @psteverific While I agree with your point, the word "tips" is not an acronym for two reasons.

    1) It uses the wrong form of "ensure". If it were an acronym, people would call them TEPS.

    2) Tipping began as an English custom among the wealthy, and it was brought to the United States as a way of flaunting one's supposed wealth. Gradually it became our culture.

    Regardless of how the custom came across the pond, originaly the custom was for weathey people to show their money purse before being served, to prove that they could pay for their fare, and were thus deserving of extra attention.
